The Problem Of State Intervention In Post-Abolition Slavery: A Critique Of Consensus, Anthony Talbott, David Watkins
David Watkins
Slavery is now illegal by all states and under international law. Contrary to the hopes of abolitionists, this state of affairs has transformed rather than eradicated slavery as an institution. Furthermore, responses by states to post-abolition forms of slavery have often been less than ideal. This paper begins by comparing two state responses to slavery in the early 20th century: the federal peonage trials in Montgomery, Alabama from 1903-1905, and the federal response to an alleged epidemic of “white slavery” from 1909-1910, culminating in the passage of the White Slave-Traffic Act. Taken together, these responses engender pessimism about the state …

In a lucid and trenchant style characteristic of Professor Hiroshi Motomura’s writing, Immigration Outside the Law offers rich descriptive and prescriptive analyses of three major themes underlying debates about unauthorized migration: the meaning of unlawful presence, state and local involvement in the regulation of unauthorized migration, and the integration of unauthorized migrants into American society. This review advances several ideas that I argue are important to understanding these key themes. In brief, I suggest that a more comprehensive understanding of public debates about unauthorized migration requires examining lay moral judgments about unlawful presence, the expressive functions of immigration law, and …

This presentation is a case study of challenges to investigating sex trafficking created by decriminalized prostitution. For 29 years (from 1980 to 2009) in Rhode Island, engaging in prostitution was not prohibited or regulated. Commercial sex acts were private and beyond the interest of the state. Lack of laws or regulations of prostitution created a permissive legal, economic, and cultural environment for the growth of prostitution businesses. Local police were impeded from investigating alleged sex trafficking because police had no legal cause to investigate private activities. On The Precipice Of Intersectionality: The Influence Of Race, Gender, And Offense Severity Interactions On Probation Outcomes, Kevin Steinmetz, Howard M. Henderson

This analysis examines the impact of established predictors on probation failure utilizing a large randomly selected sample of adult probationers. Initial findings suggest that race, gender, location, offense severity as well as risk assessment scores significantly predict probation failure. This study then examines interaction effects between race and gender as well as race and offense severity. Results indicate such interactions may matter in studying probation failure, despite reason to be cautious about their interpretation. Importantly, the results of the interaction model suggest that the interaction between being an African American and male is a significant predictor of probation failure. Additionally, …

Recent findings have held that offender behavioral assessments unfairly predict the probation outcomes of racial/ethnic minorities. To that end, this study examines the extent and degree to which a commonly used offender risk needs assessment instrument equitably predicts probationer success and distributes predictive error. Findings suggest that the risk needs instrument predicts most equitably for “higher risked” probationers and that error is more likely for under-classified Blacks and over-classified Whites. The discussion presents issues for consideration by policy makers, practitioners, and future researchers motivated by the minimization of predictive bias.

For 29 years (1980 to 2009) prostitution was decriminalized in Rhode Island. Lack of laws or regulations created a permissive legal, economic and cultural environment for the growth of sex businesses. During this time, sexual exploitation and violence against women and girls were integrated into the economic development of urban areas. The number of sex businesses grew rapidly during this period. Organized crime groups operated brothels and extorted money from adult entertainment businesses. Rhode Island became a destination for pimps, traffickers, and other violent criminals. The lack of laws impeded police from investigating serious crimes.

This panel will discuss the persistence of slavery in the form of human trafficking in Rhode Island. To address modern-day slavery-like practices, the U.S. passed the Trafficking Victims Protection Act in 2000 and Rhode Island passed the Trafficking of Persons and Involuntary Servitude Act in 2009. Both state and federal anti-human trafficking laws identify two types of human trafficking: forced labor and sex trafficking.

Present an analysis of seven state and federal cases of human trafficking, including forced labor and sex trafficking, in Rhode Island from 2009 until 2013. In 2009, Rhode Island passed a comprehensive human trafficking law. Since then there have been six cases of sex trafficking and one case of forced labor. Sources for information on the human trafficking cases were police reports, witness statements, court documents and media reports. Your Friends And Neighbors: Localized Economic Development And Criminal Activity, Matthew Freedman, Emily Owens

We exploit a sudden shock to demand for a subset of low-wage workers generated by the 2005 Base Realignment and Closure (BRAC) program in San Antonio, Texas to identify the effects of localized economic development on crime. We use a difference-in-difference methodology that takes advantage of variation in BRAC’s impact over time and across neighborhoods. We find that appropriative criminal behavior increases in neighborhoods where a fraction of residents experienced increases in earnings. This effect is driven by residents who were unlikely to be BRAC beneficiaries, implying that criminal opportunities are important in explaining patterns of crime.
