In this paper, we will analyse the issue of concurrence between competition and sector rules and the relation between parallel concepts within the two different legal frameworks. We will firstly examine Third Party Access in relation to essential facilities doctrine and refusal of access and we will identify the common points and objectives of these concepts and the extent to which they provide a context to each other’s implementation. The Octofoil is the offical publication of the Ninth Infantry Division Association, Inc., an organization formed by the officers and men of the 9th Infantry Division in order to perpetuate the memory of fallen comrades, preserve the esprit de corps of the Division, promote peace and serve as an information bureau about the 9th Infantry Division. The Association is made up of 9th Infantry veterans from WWII and Vietnam, spouses, widows and lineal descendants.

Rarely has a military commitment led to such intense discussion in the Netherlands as the Task Force Uruzgan (TFU) mission in Afghanistan. In February 2010, the Netherlands' coalition government even collapsed after the two largest parties failed to agree on the withdrawal of Dutch troops from Afghanistan later this year. This article deals first of all with the difficult discussion over the Afghanistan mission of the TFU. The authors then subject three ISAF operations to close scrutiny. The authors provide some suggestions to help understand better this pivotal point in the execution of the whole operation and thus give a …

Over the years, researchers have expended considerable effort in attempts to improve military planning, most notably via the provision of automated planning support tools. While there have been some successes (e.g. the DART system which was used for movement planning during Gulf war), planning still remains a very human‐orientated activity with little technical support. Why? A possible reason for this predicament is that researchers have not fully conceptualized the problem that planners face. For instance, a common approach has been to consider planning as a single process or a homogenous set of problems to be solved. Unfortunately, military planning is …

Physical-Strength Rationales For De Jure Exclusion Of Women From Military Combat Positions, Maia Goodell

Women have been serving in the military in steadily increasing numbers for decades. Nevertheless, the military remains one of the few areas in which the U.S. government decides what roles are open to women based on de jure exclusions. This Article examines the law governing de jure classification, noting that a mere normative belief about women’s proper place in society is an insufficient basis to justify a sex-based exclusion. It then probes the most common rationale advanced in support of the continued de jure exclusion of women: physical strength. This paper presents the conceptual path followed by European Union, European Commission and European Competition Network, after the Energy Sector Inquiry (2007) towards the realisation of the objective of an Energy Internal Market, fully functional and open to competition. The primary purpose of the project, as originally conceived, was to design and implement a series of applied research studies to validate the effectiveness of a blended learning ecology in the teaching of life saving medical skills to US Army combat military personnel. The project has undergone several changes to include changing the focus to the development of a Program of Instruction (POI) for Combat Lifesaver Skills (CLS). This paper examines management contracts as a paradigm for the application of relational contracts theory and especially of the theory of contractual and relational norms. This theory, deriving from Macauley's implications, but structured and analysed by I.R. MacNeil gives us a framework for the explanation and understanding of contractual obligations and business relations' rules and practice. Most of the mines that currently threaten populations were manufactured more than 50 years ago and many have been in the ground for 30 years or more. Despite the inevitable and obvious deterioration, there has been very little research into the effects of aging on landmines. In 2008, James Madison University (JMU), the Center for International Stabilization and Recovery (CISR), and C King Associates Ltd (CKA) began a study designed to understand the aging process and the range of implications for the various components of mine action. While women are officially barred from combat in the American armed services, in the current war, where there are no front lines, the ban on combat is virtually meaningless.
