Federal Climate Policy Successes: Co-Benefits, Business Acceptance, And Partisan Politics, Roger Karapin, David Vogel

While most literature on federal climate change policies has focused on failures to adopt broad policies, this article describes and explains successes in two important sectors. Regulations to improve the fuel economy of motor vehicles and efficiency standards for appliances and equipment have produced substantial reductions in greenhouse gas emissions although they largely have other goals and hence can be considered implicit climate policies.

We synthesize existing literature with our analyses of case studies to offer three explanations for the adoption of effective sectoral policies in these two sectors. First, the policies delivered politically popular co-benefits such as reducing consumers’ …

Climate change is borderless, and its impacts are not shared equally by all communities. It causes an imbalance between people by creating a more desirable living environment for some societies while erasing settlements and shelters of some others. Due to floods, sea level rise, destructive storms, drought, and slow-onset factors such as salinization of water and soil, people lose their lands, homes, and natural resources. Catastrophic events force people to move voluntarily or involuntarily. Germany is an exemplary case of an energy transition from nuclear energy and fossil fuels toward renewables in the electricity sector, but it also demonstrates repeated, increasingly successful counter-mobilization by energy incumbents and their allies. The course for Germany's energy transition was largely set with the adoption of a feed-in tariff law in 1990, but since then the energy transition has been altered by a series of policy-making episodes, each of which was shaped by the outcomes of the previous episodes; there has been a combination of reinforcing and reactive sequences. The adoption of climate policies with visible, substantial costs for households is uncommon because of expected political backlash, but British Columbia's carbon tax and California's cap-and-trade program imposed such costs and still survived vigorous opposition. To explain these outcomes, this paper tests hypotheses concerning policy design, framing, energy prices, and elections. It conducts universalizing and variation-finding comparisons across three subcases in the two jurisdictions and uses primary sources to carry out process tracing involving mechanisms of public opinion and elite position taking. Much literature on federalism and multi-level governance argues that federalist institutional arrangements promote renewable-energy policies. However, the U.S. case supports a different view, that federalism has ambivalent effects. Policy innovation has occurred at the state level and to some extent has led to policy adoption by other states and the federal government, but the extent is limited by the veto power of fossil-fuel interests that are rooted in many state governments and in Congress, buttressed by increasing Republican Party hostility to environmental and climate policy. In the absence of strong U.S. national climate change policy, California and New York, among other states, adopted relatively comprehensive and ambitious policies to cut greenhouse gas emissions during the 2000s. They adopted these policies despite political-institutional and other structural barriers similar to those found nationally, which shows that political actors have significant scope for taking effective action even under structural constraints. Executive Order 13211, promulgated in 2001, requires the federal government to consider the impact of federal action on energy independence as part of the George W. Bush’s National Energy Policy. This law review examines whether EO 13211 was used to curtail environmental protection and natural resource conservation. The article begins with a review of the procedure required of federal agencies under EO 13211 and its associated documents. The paper then examines case law and published federal rulemaking proceedings and examines how federal agencies apply tests to evaluate the potential energy effect. This study evaluated the impact of Executive Order (EO) 12898 to advance environmental justice. We conducted a review evaluating the frequency and effective use of EO 12898 since execution with particular focus following President Obama’s Plan EJ 2014. We found that both EO 12898 and Plan EJ 2104 had little, if any, impact on federal regulatory decision making. To the extent federal agencies discussed EO 12898, most did so in boilerplate rhetoric that satisfied compliance but was devoid of detailed thought or analysis. In the 21st year, with the exception of the Environmental Protection Agency, very little federal regulatory activity …

Public interest in environmental and health impacts from shale oil and gas extraction (what the public calls “fracking”) is growing. Industry claims the public outcry against the new technology is not grounded in science. In February 2013, Resources for the Future (“RFF”) published a list of high priority “risk pathways” that experts from NGOs, academia, government, and industry all agreed were real concerns about fracking. This article used the risk matrix to evaluate whether public comments in dockets of federal agencies that proposed regulation concerning hydraulic fracturing tracked expert concern. Many adolescent girls—the poorest girls in the poorest communities—already live in an “emergency.” Humanitarian crises only amplify the call on their coping and caring capacities, while exacerbating their vulnerabilities. The frequency and intensity of emergencies, including natural disasters, conflicts, and infectious disease outbreaks such as Ebola, appear to be growing.¹ These emergencies threaten entire communities and whole countries, often with global implications. The purpose of this paper is to describe global urban greenhouse gas emissions by region and sector, examine the distribution of emissions through the urban-to-rural gradient, and identify covariates of emission levels for our baseline year, 2000.We usemultiple existing spatial databases to identify urban extent, greenhouse gas emissions (CO2, N2O, CH4 and SF6) and covariates of emissions in a “top-down” analysis. The results indicate that urban activities are significant sources of total greenhouse gas emissions (36.8 and 48.6 % of total). The urban energy sector accounts for between 41.5 and 66.3 % of total energy emissions. Significant differences exist in …

Theories of environmental outcomes have been developed mostly through large-N cross-national studies, which have a structuralist bias and do not include the mechanisms through which inferred causes operate. Structured, focused case studies can help overcome those limits by incorporating political processes and identifying causal mechanisms. Here, comparisons of climate policy outcomes within Germany are used to test and develop theory, by explaining the differences among nine cases with the help of process tracing. The findings suggest that environmental-outcome theories should be modified to include: external events and advocacy-coalition formation as key processes; multiple causal paths through which green parties improve …

Climate Policy Outcomes In Germany: Environmental Performance And Environmental Damage In Eleven Policy Areas, Roger Karapin

Germany has reduced its emissions of greenhouse gases more than almost any other industrialized democracy and is exceeding its ambitious Kyoto commitment of a 21% reduction since 1990. Hence, it is commonly portrayed as a climate-policy success story, but the situation is much more complex. Generalizing Germany's per-capita emissions to all countries or its emissions reductions to all industrialized democracies would still very likely produce more than a two-degree rise in global temperature. Moreover, analyzing the German country-case into eleven subcases shows that it is a mixture of relative successes and failures.
