This article examines the international law of self-defense as it applies to the ongoing Israel-Hamas conflict to determine whether the October 2023 attacks by Hamas against Israel can be interpreted under Article 51 of the UN Charter as an “armed attack” that gives Israel the right to use military force in self-defense against non-state actors. It situates the conflict within ongoing legal and political debates, shows how this conflict fits into a changing global reality where the most dangerous security threats do not exclusively emanate from other states and concludes that Israel’s resort to force in the current conflict appears …

In Palestine, environmental management has been used as a tool of military occupation and oppression. Yet even within that context, many community-based organizations have established programs relating to environmental peacebuilding. Of these initiatives, environmental dialogue programs have received significant attention and resources, even more so since the war in Gaza began in October, 2023. However, a deeper interrogation of these programs reveals the danger that dialogue and collaboration devoid of a critical analysis of power and injustice further perpetuates systemic oppression. Moving these programs into the realm of positive environmental peacebuilding requires a willingness to engage in this structural analysis. …

This thesis examines American ambassador discourse at the United Nations Security Council from 2012 to 2019 regarding the ongoing issue of Israeli settlement expansion in the Occupied Palestinian Territories. While Israel’s settlement activity technically breaches international law as well as several UN resolutions, there is no binding aspect of the framework of international law that could compel Israel to cease its violations. This issue is further exacerbated by the fact that the United States often protects Israel from criticisms of its occupation regime in front of the international community. A great deal of research focuses on the question of why incumbents invite IEOs but do not explicitly explored the root cause of why cheating in elections occurs despite the presence of IEOs. The occurrence when incumbents in young democracies invite international election observers (IEOs) and nevertheless cheat in elections has not been fully explored. This research advances the following expectation: incumbents seeking international benefits and whose electoral institutions are not fully mature are more likely to invite IEOs and cheat in an election. Israel began constructing a separation barrier in 2003 in response to increasing terrorism and suicide bombings by the Palestinians during the Second Intifada (Dowty, 2005, p. 171). The separation barrier is an elaborate 400-mile security system of concrete walls, fences, barricades and checkpoints built to protect Israeli citizens (Vick & Arik, 2010). The wall portion of the barrier was constructed of thick reinforced concrete, stands approximately 25 feet tall, and separates the West Bank and Israel boundaries. The Israeli occupation of Palestine and its impact on the proliferation and longevity of transnational Salafi jihad is largely underestimated in current literature. In this thesis, I argue that Palestine, defined as both the nation and physical borders before the Balfour Declaration, largely contributed to the twentieth century revival of transnational Salafi jihad and is used by both Al Qaeda and ISIS as liberation and annihilation movements, respectively. This study reviews the current US and Israel militarized response to Palestine, the negative impacts on the Palestinian and Israeli people that result from this policy, and the military-industrial complex that benefits from the US-Israel relationship. I also note that the military industry profits from the Israel-Palestine conflict and, thus, has an incentive for the conflict to continue. I argue that despite billions of US dollars that have been appropriated by the U.S. Congress for Israel’s security, the US and Israel have failed to build peace in the region, ultimately wasting funds and exacerbating current conflicts. This monograph explores the emerging challenge of nonstate actors’ anti-access and area denial (A2/AD) strategies and their implications for the United States and its allies by looking at two regions, the Middle East and Eastern Europe, with case studies such as Hezbollah in Lebanon, Hamas in the Gaza Strip, the Houthis in Yemen, and separatist groups in Ukraine. This dissertation concerns how Jewish-Muslim and Israel-Palestine grassroots activism can persist in the face of threats to the safety, freedom, lives, or even simply the income and employment of those engaged in acts of sustained resistance. At the heart of the study are the experiences of participants in the Hashlamah Project, an inter-religious collaboration project, involving Jews and Muslims. The author uses qualitative methods to examine the reasons why Hamas has endured, despite facing constant military pressure from Israel and suffering substantial casualties. The author finds that the organization has survived because it has been underestimated and dealt with improperly. Now that it has experienced relative success, Hamas has succeeded in discrediting, to a certain extent, the Israeli government. The author recommends that Israel find more effective ways to turn Hamas’s supporters against it in order to weaken the organization and ensure its defeat.

In this article, the author examines the effectiveness of the Obama administration’s handling of US-Israeli relations via a qualitative analysis of the factors and players involved in the complex dynamics of the President’s dealings with Israel. This thesis is an examination of the long historical processes that have led to the Israel/Palestine conflict to the contemporary period, focusing mostly on the period before Israeli independence and the 1948 war that created the Jewish state. As Zionism emerged at the turn of the twentieth century to combat the antisemitism of Europe, practical and political facets of the movement sought immigration to Palestine, an area occupied by a large population of Arab natives. Despite seemingly discriminatory practices at the border directed towards US citizens, no formal academic work has been conducted on the subject. This study is the first of its kind, which examines the phenomenon of the denying and banning of US citizens from the external Israeli border crossings. It draws upon the cases of 110 US citizens who have been banned or denied from the external Israeli border crossings from 1987-2015. This study finds that denial is often associated with Palestinian Americans, Arab Americans, Muslim Americans, Black Americans and Americans who personally identify as activists or are considered by border officials …

The failure to reach a comprehensive peace agreement has precluded progress on cooperative water management. A new agreement on water could benefit both sides and help protect important water resources from environmental degradation, yet no talks have occurred outside of more difficult comprehensive negotiations. This study monitored the intelligence and foreign policy actions of Israel, Iran, and Saudi Arabia from August 2013 to August 2014. Data was collected from coverage by Associated Press, The Wall Street Journal, and Al-Jazeera, three reliable and respected news sources that cover global events. The actions taken by foreign policymakers in these countries were recorded throughout the study period.

These actions were organized into a taxonomy based on whether they were intelligence-based or non-intelligence based. This dissertation examines the global mobility of security knowhow in relation to the management of terrorism in megacities. Specifically, it offers three insights. First, it shows how historical events are performed as sites in need of transnational policy intervention. Second, it enables an understanding of how and why the sourcing of policy ‘models’ actually takes place. Third, it sheds light on how mobile policy schemes travel geographically and are put to work in particular contexts. In doing so, it elaborates on the conditions under which policies move geographically but also addresses the kinds of constraints and contradictions they face.

While I think it is too early to evaluate whether this round of hostilities is morally just in terms of jus in bello, the means employed in the conduct of war, I think Operation Protective Edge is justified in terms of jus ad bellum, i.e., the reasons that brought about this war. I presume a lot will be written about Israel’s conduct of war, enough to fill volumes. Here I clarify my position and its underlying principles.
