This dissertation investigates the underexplored relationship between character epistemology and its potential to explain behavior, decision-making, and culture within the criminal justice system, particularly the police. Building on the existing theoretical framework of evidence-based policing (EBP) and the recognized gap in understanding police receptivity to science, this study hypothesized that intellectual character at personal and collective levels positively correlates with science receptivity.

Epistemic character was defined through the aggregation of four traits: open-mindedness, defensiveness, insouciance, and groupthink. Science receptivity was measured by openness to change, desire to learn, reliance on intuition, and mistrust of science. Data were collected through surveys …

Over the past few decades, the largely hidden, secretive, and widely used system of plea bargaining has caught the fervent attention of scholars. The Shadow of the Trial model has been central to much of the plea-bargaining literature, despite significant critiques about its oversimplification. The model posits that defendants and their attorneys make plea decisions based largely on the estimated probability of conviction and the severity of the sentence to which the defendant could be exposed at trial.

The model, however, assumes that all actors are rational, equally risk averse, have no competing interests, and possess high predictive accuracy. It …

A policy's general deterrent effect requires would-be offenders to be aware of the policy, yet many adolescents do not know they could be registered as sex offenders, and even adolescents who do know may still commit registerable sexual offenses. We tested whether peer influences shape the perceived costs/benefits of certain sexual offenses and, subsequently, registration policy's general deterrent potential in a sample of policy-aware adolescents. The more adolescents believed their peers approve of sexting of nude images, the more likely they were to have sexted. Much research has been completed on the forms of crime control theater (CCT), and the impact that the existence of CCT laws have on society. Research on CCT laws has shown that they are definitively unsuccessful in providing the safety they were created to provide. This thesis will utilize completed research to explain the main psychological phenomena holding people back from decreasing their support for CCT laws. It will also describe proven methods of correcting misinformation in order to change the perceptions of people who support crime control theater laws, and provide suggestions for how research should be continued.

Empirical studies have pointed to the increasing importance of procedural justice as a tool for improving the relationship between the police and local communities. The mediating role of procedural justice continues to be embraced by scholars, practitioners, and community members; as a result, we examine in the present study African Americans’ attitudes toward the police via the interpretive lens of procedural justice policing. Using procedural justice questions found in the social-psychology literature, we interviewed seventy-seven African Americans in Durham, NC, to assess their views about the U.S. police. Cultural stereotypes that link Black race to crime in the U.S. originated in and are perpetuated by policies that result in the disproportionate criminalization and punishment of Black people. The scientific record is replete with evidence that these stereotypes impact perceivers’ perceptions, information processing, and decision-making in ways that produce more negative criminal legal outcomes for Black people than White people. However, relatively scant attention has been paid to understanding how situations that present a risk of being evaluated through the lens of crime-related stereotypes also directly affect Black people. Despite the low rate of discretionary parole release in New York, much is still unknown about the processes underpinning parole decisions. The present paper delves into how aggravating and mitigating parole case characteristics (e.g. institutional behavior) relate to parole decisions and the perceived humanness of parole applicants. The paper also examines how construal level can moderate the above relationships. Finally, a moderated mediation model outlining the pattern of these relationships is posited and tested. 122 New York residents were recruited online and randomly assigned to read either an abstractly or concretely construed transcript for an interview with a parole applicant. …

This study examined the influence of mental illness on mock juror decisions in a criminal case. With the knowledge that mental illness continues to be highly stigmatized, I hypothesized that the presence of a mental illness in a defendant of a violent crime would have significant effects on participants’ case decisions and their perception of the defendant’s guilt. Participants in the study read a fictional vignette describing a homicide and a defendant in which the defendant’s mental illness diagnosis was varied (major depressive disorder, schizophrenia, borderline personality disorder, no mental illness). White Racial Identity is a relatively new concept with little to no consensus as to the operationalization of such identity. The first ever White Racial Identity model was developed by Janet E. Helms in 1990. The role of White racial identity has been studied in the context of the racial gap in employment and its influence on racial attitudes, but it has yet to be studied in the context of the juvenile justice system. Studies and victimization surveys suggest that many, if not most, crimes are not reported to legal authorities. The overarching aim of this project was to examine the roles of individual and contextual differences in bystanders’ willingness to report crimes to, and cooperate with, legal authorities. A sample of 1,434 adults in the U.S. completed a survey in which they read and responded to crime vignettes and responded to items theoretically measuring individual differences in legal socialization, perceived legitimacy, the need for cognitive closure, right-wing authoritarianism, social dominance orientation, and the general willingness to cooperate. This research sought to identify a potential process by which intergenerational crime occurs, focusing on the effect of parental incarceration on adolescents’ subsequent arrests. We drew from Matsueda’s work on reflected appraisals as an explanatory mechanism for this effect. Thus, the present research examined whether caregivers’ and adolescents’ expectations for adolescents’ future incarceration sequentially mediated the effect of parental incarceration on adolescents’ actual arrest outcomes. Propensity score matching was used to examine this effect in a sample of 1,735 15- to 16-year-olds using NLSY97 data. Parental incarceration was positively related to caregivers’ expectations of adolescents’ future arrest. Moreover, caregivers’ expectations …

The impact of stress on eyewitness recall and identification accuracy has been studied extensively but with somewhat inconsistent results. Understanding the effects of stress are important if they are to be generalized to victims or witnesses of real crimes. This study consisted of two experiments that used an extreme haunt and a haunted house to examine attendees’ ability to recall details of and identify actors encountered, as a function of state anxiety and in the context of Deffenbacher’s (1994) catastrophe model of memory performance under anxiety. Objective: The current study tests whether jury-eligible adults follow judicial instructions to disregard information about a defendant’s pretrial competency status when deciding whether he is guilty or not guilty by reason of insanity. Hypotheses: It was anticipated, because of the effects of hindsight bias, that defendants who were previously found competent to stand trial would be less likely to be found NGRI than a defendant who previously was deemed incompetent but has been restored to competency for trial. While a growing number of studies have examined target selection by terrorists, the current study is the first to consider how combinations of factors present situated opportunities for terrorists to select particular types of targets as opposed to others. Despite growing recognition that misdiagnoses of child abuse can lead to wrongful convictions, little empirical work has examined how the medical community may contribute to these errors. Previous research has documented the existence and content of stereotypes that associate race with child abuse. The current study examines whether emergency medical professionals rely on this stereotype to fill in gaps in ambiguous cases involving Black children, thereby increasing the potential for misdiagnoses of child abuse. Sex offender registration laws are widely implemented, increasingly restrictive, and intended to serve both specific and general deterrent functions. Most states have some form of policy mechanism to place adolescents on sex offender registries, yet it remains unclear whether adolescents possess the requisite policy awareness to be deterred from sexual offending. This study examined awareness of sex offender registration as a potential sanction and its cross-sectional association with engagement in several registrable sexual behaviors (sexting, indecent exposure, sexual solicitation, and forcible touching) in a community sample of 144 adolescents.
