This thesis investigates the problem of gender disparities present within the legal profession in order to discover their causes and ways to mitigate them. Currently, there are a variety of gender disparities in the legal profession. Women are paid less than their male counterparts, are exposed to sexual harassment and violence more often, and receive fewer leadership opportunities, to name just a few of these disparities. While these disparities are documented in larger firms, little data exists on the extent of such issues in smaller firms, especially in the southeastern United States. Throughout its turbulent history, Colombia has seen drastic changes in structure and administration. From military coups to shaky coalitions, the country’s infamous instability has long forced its citizens to find better prospects elsewhere. However, with the rise of the Maduro administration in Venezuela, Colombia faced a massive new flow of migrants and was forced to rectify current circumstances without properly addressing its internal issues beforehand. Colonial relations between colonizer and colonized are an interesting yet often understudied part of the legal field. This thesis will focus on these links within the relationship between France and two of its former colonies: North Africa and Indochina. In order to discover more information on these relationships, I take a historical approach focusing on legal documents, debates, and decrees, both from the French government and international bodies and representatives such as the United Nations High Commissioner for Refugees. President Trump has become immersed in civil litigation since announcing his candidacy for the United States presidency. These lawsuits, which include assertions of presidential immunity under state jurisdiction and claims of constitutional violations under the Emoluments Clauses, present unique legal concerns that have never been challenged in the Supreme Court. Precedent shows that the president has never been exempt from the judicial process for his unofficial actions, although this may have led to unforeseen consequences. This paper investigates the role of gender on law clerks from the federal appellate clerks. There has been significant scholarship on the importance of the gender of judges and on the role and influence of law clerks; however, to this date there has been no analysis of how the gender of law clerks may or may not influence the clerkship experience. Deference To Deference: Examining The Relationship Between The Courts And The Political Branches Through Judicial Deference And The Chevron Doctrine, Christopher Yao

Judicial review of agency rulemaking sits atop a nexus between all three branches of American government, the legislature, the executive, and the judiciary. Chevron v. NRDC (1984), a landmark case in administrative law, and its resulting doctrine of strong judicial deference to agencies in their interpretations of statute, are paradoxical in their creation. Although Chevron was decided at the height of Reagan-era deregulation, it greatly enhanced the power of administrative agencies, allowing them to reinterpret the meaning of their statutory directives as needed to justify changes to regulations with less scrutiny from the courts. This thesis explores whether stateless persons are more vulnerable to human trafficking and why. My primary example will be the 2013 Dominican Republic Supreme Court ruling, which rendered Haitian-Dominicans stateless. To understand current Dominican Republic-Haiti relations, this thesis addresses contentious historical accounts of these countries’ relations, particularly from the 1960’s to 2015. This case study will focus on the vulnerable relationship of citizens to a state, specifically the vulnerability of defacto statelessness versus dejure statelessness. I argue that dejure statelessness is a particularly severe condition that contributes to human trafficking. This thesis draws upon both primary and secondary sources including, …

Divorce devastates a family, and with over 40% of first marriages ending in divorce in the United States, it is important to analyze the effect divorce has on each member of the family. This paper aims specifically at the economic effect of divorce on women, and furthermore, if the implementation of a no-fault divorce clause in state law has negatively impacted women’s wellbeing. Women’s well-being is determined by annual income divided by annual need. In 1965, the United States Congress passed the Immigration and Nationality Act, attempting to remove racial, religious, and cultural discrimination from the immigration system. However, the infamous act and subsequent legislation have caused unintended consequences. Illegal immigration has skyrocketed despite a massive increase in border enforcement; and Central Americans, particularly Mexicans, have become the target of racial and cultural discrimination, much like the Southern European immigrants of the early 1900s. The USA Patriot Act, passed in September 2001, changed the standards of Fourth Amendment rights and protections. The USA Patriot Act gave more authority to the government and diminished the rights and privileges given to individual citizens. An eruption of Fourth Amendment legislation and cases arose in the states following the passage of the act and it created a problem for policy and implementation. The legislation presented, for the USA Patriot Act and wiretapping/eavesdropping laws, demonstrated the differences in opinions on these issues on the individual state level. VA State Senator Mark Earley, a lawyer by trade, addressed the Norfolk-Portsmouth Bar Association in October 1995, and claimed that the profession, in order to survive, must engage in both serious talk and sincere action. As a result, much of the negative feeling about lawyers within American society will begin to change as the public sees attorneys for what they should be -- leaders in their everyday interactions with clients.
