Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Contributions to Books
Areas beyond national jurisdiction are the largest environment on earth and marine genetic resources are its new, and perhaps final, frontier. It is no wonder, then, that the scope and protection of marine genetic resources in this oceanic space have been hotly contested and that a new doctrine for ocean governance has been coined in this context: mare geneticum. This chapter examines different definitions of marine genetic resources debated in the ongoing treaty negotiations over areas beyond national jurisdiction (the BBNJ), the conflicting interests involved, and how the law-science relationship has figured in these debates. Ultimately, many of the debates …
Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Contributions to Books
This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book discusses the juridical thinking that has enshrined the land/sea divide into contemporary governmental infrastructures, disciplinary traditions, and regulatory apparatuses, and charts the disastrous implications that such a legal fixation on the land/sea binary has wrought on human and other-than-human lifeworlds. As the collection proceeds, a second broad theme emerges, building on the first: when one rethinks the abstraction of law as played out on the ground, the “ground” itself shifts and fundamental divisions between land and sea that serve as the …

Restructuring Legal Geography, Reecia Orzeck, Laam Hae
Faculty Publications-- Geography, Geology, and the Environment
We argue that legal geography’s ability to produce holistic knowledge about law and legal relations is hampered by the qualified dominance in the field of what we refer to as a contingency orientation. This phrase refers to both the belief that law, legal relations, and legal outcomes are more open and contingent than they appear to be, and to an empirical interest in bringing to light moments when law, legal relations, and legal outcomes appear to depart from dominant representations of these as closed, determinate, aspatial, and wholly formal. Because holistic accounts of the social world require attention to both …

TSOS Interview Gallery
The Northwest Immigrant Rights Program has been around for 35 years, started in 1984 specifically to help Central American refugees during the mid-1980s, when they were fleeing civil wars. A pro-bono group of attorneys performing "direct legal representation", helping low income community members who are navigating different aspects of the immigration system. NWIRP also engages in "systemic advocacy" which attempts to change systems and policies revolving around asylum and immigration rights.

A Research Framework For The Geographic Study Of Exotic Pet Mammals In The Usa, Gabrielle C. Tegeder
A Research Framework For The Geographic Study Of Exotic Pet Mammals In The Usa, Gabrielle C. Tegeder
Department of Geography: Dissertations, Theses, and Student Research
Exotic animals are not well-represented in geographic studies, even in the emerging sub-field of animal geography. With the dearth of exotic animal studies, and the relevance of exotic pets in the public consciousness and in the news, a basic, introductory study such as this is necessary to begin examining the myriad ways in which exotic pets intersect with, and have influence in, both the site and situation of modern human-oriented environments.
Exotic pet attack incidents and both state and federal laws regarding the private ownership of exotic mammals as pets were examined in detail within the scope of this research. …
Interpreting, Stephanie Jo Kent
Interpreting, Stephanie Jo Kent
Doctoral Dissertations
What do community interpreting for the Deaf in western societies, conference interpreting for the European Parliament, and language brokering in international management have in common? Academic research and professional training have historically emphasized the linguistic and cognitive challenges of interpreting, neglecting or ignoring the social aspects that structure communication. All forms of interpreting are inherently social; they involve relationships among at least three people and two languages. The contexts explored here, American Sign Language/English interpreting and spoken language interpreting within the European Parliament, show that simultaneous interpreting involves attitudes, norms and values about intercultural communication that overemphasize information and discount …
The Inclusive Exclusion Of Latino Immigrants In Lexington, Kentucky, Vanessa Marquez
The Inclusive Exclusion Of Latino Immigrants In Lexington, Kentucky, Vanessa Marquez
Theses and Dissertations--Geography
This thesis is a case study analyzing how the Latino immigrant community in Lexington, Kentucky is responding to the national push for restrictive legislation. Based on interviews conducted throughout the summer and fall of 2012, I examine the relationship between federal policies and young undocumented immigrants in Lexington, Kentucky, a southern locale with a relatively small but growing foreign-born Latino community. Employing the notion of the included exclusion, I look at the newly implemented Deferred Action for Childhood Arrivals policy. The Deferred Action for Childhood Arrivals policy highlights an opening present in immigration law in which young immigrants are simultaneously …
Access To Spatial Data: The Political Power Of Legal Control Mechanisms, Patrice A. Day
Access To Spatial Data: The Political Power Of Legal Control Mechanisms, Patrice A. Day
Theses and Dissertations
According to the U.S. Supreme Court (Island Trees School District v. Pico, 457 U.S. 853, 1982), the Constitution presupposes that the free flow of information between the government and the public is essential to maintaining an informed citizenry, which in turn is essential to holding governments accountable. However, local governments are increasingly using various legal mechanisms to limit public access to geographic information (GI), and this in turn can potentially disrupt this balance. Licensing and copyright are two such mechanisms that local government agencies are using to limit GI access and distribution.
If information is power, whoever controls information, controls …
Towards Voluntary Interoperable Open Access Licenses For The Global Earth Observation System Of Systems (Geoss), Harlan Onsrud, James Campbell, Bastiaan Van Loenen
Towards Voluntary Interoperable Open Access Licenses For The Global Earth Observation System Of Systems (Geoss), Harlan Onsrud, James Campbell, Bastiaan Van Loenen
Harlan J Onsrud
Access to earth observation data has become critically important for the wellbeing of society. A major impediment to achieving widespread sharing of earth observation data is lack of an operational web-wide system that is transparent and consistent in allowing users to legally access and use the earth observations of others without seeking permission from data contributors or investigating terms of usage on a case-by-case basis. This article explores approaches to supplying a license-based system to overcome this impediment in the context of the Global Earth Observation System of Systems. It discusses the benefits and drawbacks of the explored approaches and …
Creative Commons Licensing And Non-Creative Geographic Data, Harlan Onsrud
Creative Commons Licensing And Non-Creative Geographic Data, Harlan Onsrud
Harlan J Onsrud
Why does the scientific community need a simple method for letting each of us know that we are allowed legally to build on the work and data products of each other without asking permission? Does merely following the traditional practices of science and giving credit now make me a lawbreaker? What's the problem, how did we get here and what's the solution? Why does the solution for creative works not apply to geographic and other utilitarian data and databases? This presentation addresses these questions and approaches for arriving at solutions.
Liability For Spatial Data Quality, Harlan Onsrud
Liability For Spatial Data Quality, Harlan Onsrud
Harlan J Onsrud
Liability in data, products, and services related to geographic information systems, spatial data infrastructure, location based services and web mapping services, is complicated by the complexities and uncertainties in liability for information system products and services generally, as well as by legal theory uncertainties surrounding liability for maps. Each application of geospatial technologies to a specific use may require integration of different types of data from multiple sources, assessment of attributes, adherence to accuracy and fitness-for-use requirements, and selection from among different analytical processing methods. All of these actions may be fraught with possible misjudgments and errors. A variety of …
