In this article, I consider the prospects for and impediments to judicial cooperation with the United States. I do so by describing a personal journey that began more than twenty years ago when I first taught and wrote about international civil litigation. An important part of my journey has involved studying the role that the United States has played, and can usefully play, in fostering judicial cooperation, including through judgment recognition and enforcement. The journey continues but, today, finds me a weary traveler, more worried than ever about the politics and practice of international procedural lawmaking in the United States. …

United States Sovereign Debt: A Thought Experiment On Default And Restructuring, Charles W. Mooney Jr.

This chapter adopts the working assumption that it is conceivable that at some time in the future it would be in the interest of the United States to restructure its sovereign debt (i.e., to reduce the principal amount). It addresses in particular U.S. Treasury Securities. The chapter first provides an overview of the intermediated, tiered holding system for book-entry Treasuries. For the first time the chapter then explores whether and how—logistically and legally—such a restructuring could be effected. It posits the sort of dire scenario that might make such a restructuring advantageous. It then outlines a novel scheme …

The purpose of this study was to first identify the most accurate definitions of intercultural competence by the examination of other representative works on the topic, then to elaborate on the different characteristics and articulate the theoretical underpinnings of the intercultural development inventory (IDI) used to assess intercultural competence. Strategies for implementation of information learned from the IDI instrument are presented along with results of the writers own assessment in order to create a more personalized, detailed study. The Korea War has left deep scars on the psyches of Koreans in Korea and throughout the world. Among many ordeals that Korean citizens had to suffer during and after the war, the separation of the family was one of the most tragic continuing results of the war. Countless individuals were forcibly severed from their family members in North Korea and most haven’t seen their separated relatives for over six decades. Programming decisions by international NGOs operating in the area of development are a function of both humanitarian and pragmatic concerns. Helping communities establish sustainable agricultural cooperatives to address problems of undernutrition, for example, motivates programs implemented by NGOs in the food security sector. But NGOs are strategic actors and must also be attentive to organizational imperatives in regard to funding. These concerns relate to donor preferences and the reality that aid projects must demonstrate tangible results. Based on previous academic literature, relationships between non-governmental organizations and governments are categorized as being either generally cooperative or generally conflictual, and vary state to state. Considering an assumption that more freedom afforded to a state provides space in society for a more vibrant third sector, it seems intuitive that states with more freedom will experience more cooperative relationships with the NGO sector than states with less. However, six case studies illustrate that this may not always be a correct assumption. The United States and China have turned to Africa as an additional source of oil to ensure reliable, secure access to oil supplies in the future. While China stresses noninterventionist foreign policies, the US, at least rhetorically, if not in practice, links its energy policy in Africa to its foreign policy goals. China's petroleum diplomacy in Africa has raised concern among some scholars and policymakers about the effect an increased Chinese economic presence will have on American foreign policy objectives.

Throughout the course of history, literature and examination on the impact of civil war has focused little on women, especially in the cases of wartime rape. While the factors which sustain wartime rape are examined with frequency, using gender as an analytical lens, the analysis regarding post-conflict sexual violence and rape is studied far less, leading to the question: what factors are correlated with the continuance of widespread acts of rape even after the cessation of official conflict? Theories of social movements suggest that 'objective' changes in the structure of political opportunities and their interaction with mobilizing and framing mechanisms render a system vulnerable to mass protest. By examining the variables relevant to such interaction, this study seeks to account for the emergence and form of the 2009 Green Movement in Iran. This research uses the congruence method and process traces the movement adherents' activities, mainly their use of Information Communication Technologies, and investigates the so-called opposition leaders' activities and statements. Wartime sexual violence is often assumed to be inevitable during conflict yet empirical evidence indicates that sexual violence varies in type and frequency within and across conflicts as well as among armed groups. The conditions associated with the stability of democratic global governance have been a leading concern of political sociology. Globalization, a situation of ‘governance without government,’ has accountability gaps that International Non-Governmental Organizations—religious and secular—bridge with activism. They strengthen democratic norms by exercising soft power as accountability mechanisms in international relations. Religious and secular accountability mechanisms differ in both structure and function. The past two decades have seen a wealth of papers on policy diffusion and policy transfer. In the first half, this paper reviews some of the trends in the literature by looking backwards to the political science diffusion literature, and forwards to the expanding multi-disciplinary social science literatures on policy ‘learning’, ‘mobilities’ and ‘translation’ which qualify many of the rationalist assumptions of the early diffusion / transfer literatures. When people are asked the question, What is the source of Saudi Arabia’s power? Who would cite factors other than oil? This equation of Saudi power exclusively with its oil wealth is mistaken. Historically, a principal and the most consistent source of Saudi power at the domestic, regional and global levels has not been revenues from oil, but the cultural power that inheres in a Kingdom that is both the capitol of the Muslim and Arab worlds. Israel recently launched a spate of attacks on UNRWA, the UN Agency serving Palestinian refugees, which could herald another attempt to shut the Agency down. At the same time, UNRWA faces serious external and internal challenges that, given the history of Western attempts to use it to resettle Palestinian refugees, could result in shifts in the Agency’s mission and mandate, as happened briefly in the post-Oslo period.
