The New International Regime Of Liability And Compensation For Oil Pollution Damage : Status And Trends, Hanling Wang

The new international legal regime of liability and compensation for oil pollution damage under the 1992 Conventions mainly consists of one definition, two tiers of compensation scheme and three principles. Firstly, one definition—pollution damage. This definition is the basis of criteria of determining the admissibility of claims under both CLC and Fund Convention. Secondly, two tiers: the shipowners’ liability under CLC and the supplementary IOPC Fund. Strict liability, higher liability limits and compulsory insurance form the basic principles of the regime. The purpose of this literature review was to investigate the effectiveness of various play therapy interventions for decreasing developmentally inappropriate aggression of children. Psychoanalytic, cognitive-behavioral, and person-centered approaches of play therapy were reviewed. Each of the three theoretical approaches to therapy was described in relation to the aggressive behaviors of children. Similarities and differences among the three therapies were discussed. Efficacy of the interventions was presented based on published literature only. More studies of the various types of play therapy, particularly in relation to the aggressive behaviors of children, need to be conducted and results disseminated.

Beyond The Limits Of Equity Jurisprudence: No-Fault Equitable Subordination, Rafael I. Pardo

In two 1996 decisions involving equitable subordination of claims in bankruptcy cases, United States v. Noland and United States v. Reorganized CF&I Fabricators of Utah, Inc., the Supreme Court did not answer the question of whether a bankruptcy court must find creditor misconduct before it equitably subordinates a creditor's claim. This Note argues that the Court should have established a bright-line rule that requires such a finding, using prepetition, nonpecuniary loss tax penalty claims of the IRS as a model. After showing that, as codified in the Bankruptcy Code, the doctrine of equitable subordination requires a finding of creditor misconduct, …

A Cross-Case Study Of Teacher Perceptions Of Program Design And Teaching Efficacy: The Seaview Reading Support Program, Susan L. Bowers Smith Edd

Teachers at Seaview Elementary School developed an innovative reading support program delivered by classroom teachers to increase the achievement of children who struggled to read literature in the district's core curriculum. Although studies of the program's impact on student achievement indicated that many of the children who received services in the classroom were able to fluently read grade level materials and improve their scores on standardized tests, issues created by the additional burden of this instruction on some teachers prevented the integration of the program into other grade levels and schools in the Seaview School District and Seaview Elementary School. …

This study identified defendant characteristics that are related to pretrial outcome (success or failure pending trial) in Virginia. The study also investigated the potential differences in predictors across community types (Large Urban, Small Urban, Mixed, and Rural). Identification of factors that are predictors of outcome, as well as any differences across community types, can assist judicial officers in making the bail decision. The bail decision, to release or incarcerate a defendant pending trial, is a monumental one. Judicial officers must attempt to fairly and equitably balance the rights and needs of the defendant with those of the public at large. …

Adolescents need access to vital information on how to help a friend who is contemplating suicide. They need to be able to identify the signs and seek assistance from an understanding adult.
This research project, What About Me? The final question of a suicidal teen, was designed to determine whether reading an adolescent novel can educate teens about depression and suicide awareness. I wrote the adolescent novel so young adolescents would be able to relate to the main character and learn from her mistakes.

I examine the robustness of monetary equilibria in a random matching model where a more efficient mechanism for trade is available. Agents choose between two trading sectors: the search and the intermediated sector. In the former, trade partners arrive randomly and there is a trading externality. In the latter a costly matching technology provides deterministic double-coincidence matches. Multiple equilibria exist with the extent of costly matching endogenously determined. Money and “mediated” trade may coexist. This depends on the size of the probability of a trade, relative to the cost of deterministic matching. This outcome is inferior for an increasing returns …

This article complements the substantial body of literature produced over the last three decades on the export of hazards from developed countries to developing countries. After reviewing the central arguments proposed by this literature, the authors add to the debate by focusing on the role of national actors in the importation of these hazards, based on the experience of late 1970s’ developments in the petrochemical industry in Brazil. The issue regarding relationships between the status of women, economic health for all people, and social justice is a challenge in every society today. Until fairly recently, poverty and under development were assumed to put all members of affected households - men, women, and children - at an equal disadvantage. "Households" were regarded as static entities where labor and resources are pooled and equally shared. The implicit conclusion was that changes thought of as beneficial for development would be neutral in their effects on the different members of the households. This is illustrated in the rising trend for incomes and consumption: between 1965 and 1985 consumption per capita in the developing world went up by almost 70%. The relationship between women of color and community economic development is fundamentally a question of income. And, for women, questions of income more often than not become questions of pay equity - whether or not women and men are receiving equal pay for equal, or comparable work. Because the economy retains entrenched vestiges of sexual discrimination, the solutions to such problems lie within the political realm, where laws to ensure equality are created and enforced.
