In this Article I consider whether the existing international legal human rights regime enjoys political authority over sovereign states. In particular, I explore whether, just as states can cite their role as the primary institutions that protect human rights in order to justify their claim to authority over their citizens, perhaps the current human rights regime might plausibly cite its secondary role in securing human rights in order to ground its authority over these states.

Comparatively, the lawmaking process in presidential systems is often comprised of negotiations between a legislative body, tasked with authoring and legislating laws, and an executive, who must authorize and administer the enactment of the law. While executives are often empowered with certain constitutional powers to help influence the lawmaking process, these powers are typically constrained and supervisory in nature. Presidents are rarely given broad-and-discretionary legislative powers, since lawmaking is ultimately the responsibility of the legislative body; however, this does not hold true for the case of Brazil. Do institutions matter? This dissertation examines the role of institutions in the context of comparative direct democracy. Through an institutionalist framework, this study considers how the context in which the mechanism of direct democracy is first introduced has an impact on later usage, and how individuals operate when constrained by those very institutions. In particular, I examine the cases of Italy, France, Uruguay, and Venezuela and find that the inclusion of direct democracy mechanisms (most commonly, the referendum device) is more likely to occur when previously excluded "out-groups" participate in constitutional formation. The rise of large developing countries has led to considerable discussions of re-balancing global relations and giving greater priority to understanding South-South relations. This paper, in exploring the central ideas of Chinese and Brazilian foreign policy and the behavior of these two rising Southern countries toward Sub-Saharan Africa, argues that the English School of International Relations is well suited to understanding the intentions and actions that characterize South-South relations.

To date, the relationship between diplomacy and international sport has been relatively under-theorized. This paper seeks to redress the deficiency by proposing an analytical taxonomy of the multiple convergences between international sport and diplomacy. The principal analytical distinction to be drawn is between (1) international sport consciously employed by governments as an instrument of diplomacy and (2) international-sport-as-diplomacy, the diplomatic representation, communication and negotiation between non-state actors that take place as a result of ongoing international sporting competition.

In May 2013, the first all-plastic, 3D printed gun was fired. This paper offers a detailed description of the origins and development of the printable gun. It elucidates the transformation of the principal narrative in the increasing media coverage from circumventing arms regulation to defending free speech, highlighting the role of Defense Distributed and their strategic framing of the printable gun. Finally, the uptake of the latter narrative by early popular and scholarly contributions is discussed. It is well known that Hans Kelsen and Jürgen Habermas invoke realist arguments drawn from social science in defending an international, democratic human rights regime against Carl Schmitt’s attack on the rule of law. However, despite embracing the realist spirit of Kelsen’s legal positivism, Habermas criticizes Kelsen for neglecting to connect the rule of law with a concept of procedural justice (Part I). I argue, to the contrary (Part II), that Kelsen does connect these terms, albeit in a manner that may be best described as functional, rather than conceptual. I propose to criticize two strands of argument - contractarian and utilitarian – that liberals have put forth in defense of economic coercion, based on the notion of justifiable paternalism. To illustrate my argument, I appeal to the example of forced labor migration, driven by the exigencies of market forces. In particular, I argue that the forced migration of a special subset of unemployed workers lacking other means of subsistence (economic refugees) cannot be redeemed paternalistically as freedom or welfare enhancing in the long run. In this paper I argue that the discourse theoretic account of human rights defended by Jürgen Habermas contains a fruitful tension that is obscured by its dominant tendency to identify rights with legal claims. This weakness in Habermas’s account becomes manifest when we examine how sweatshops diminish the secure enjoyment of subsistence, which Habermas himself (in recognition of the UDHR) recognizes as a human right. Discourse theories of human rights are unique in tying the legitimacy of human rights to democratic deliberation and consensus. In the present paper, the objective is to investigate if multiculturalism is good for children. The method is to use secondary sources, as well as current examples from Swedish society, to show how multiculturalist policies have negative consequences for minority children's rights. The paper, as well as previous research, reveals that parents of immigrant origin often forbid children to attend school activities such as camps, gymnastics, swimming, and lessons in music and religion. Some scholars have stated that an “age of apology” began in the 1990s (Brooks 1999: 3)—that apologies now are considered standard and beneficial practice in business, domestic politics, and international affairs. Judith Armatta, a lawyer and journalist, attended the proceedings of the trial of former Serbian president Slobodan Milošević over a period of nearly three years. During this period, the court was in session for 466 days, interrupted by repeated breaks necessitated by the accused’s increasing health problems. Charged with sixty-six counts of war crimes, crimes against humanity, and genocide, Milošević declined to have counsel appointed, electing instead to defend himself.
