Cultural identity represents the impending problem that must be overcome in the integration process of the European Union. The significance of the Maastricht Treaty is now embodied in its implementation from the European super-national level to the national one. In this regard, the citizens of each member state appear to be confronted by the bifurcating enigma posed by the European integration issue that challenges the psycho-sociological perception of nationhood. Lieber argued that external liberty is an outgrowth of internal freedom. Real freedom is “perpetual, individual, and relates to the whole being.” Liberty is “granted, guaranteed, and, therefore, generally of a public character.” It is the political expression of this preexisting moral condition of the people. It is a practical result of flourishing institutions of self-government.

In 1993, Lani Guinier was nominated to head the Justice Department's Civil Rights Division. Her nomination was withdrawn after she was accused of being too liberal, if not radical, on issues relating to voting rights law. This article discusses her views, and finds that her writings were not clear enough to either support or debunk the accusations of radicalism.

The Immigration and Naturalization Service (INS) is an agency with responsibility both for enforcing the immigration laws and conferring legal status and other benefits. This author finds that at times these dual roles create conflict, mistrust in the community, and violations of the rights of aliens. This Article critically examines an undercover operation conducted in 1993 by the San Diego District Office, which lured aliens to deportation through INS offers of legal status. The Article discusses the regulatory and statutory provisions governing INS undercover operations and the rights of aliens subject to final orders of deportation. It continues with an …

Judicial Review Of Discretionary Immigration Decisionmaking, Michael G. Heyman

The Immigration and Nationality Act vests enormous discretion in the Attorney General and subordinates, such discretion exercised frequently at all levels of the immigration system. Despite this, though, judicial review of these decisions has followed a very uneven, troubled course. This Article explores the reasons for this, focusing first on the Administrative Procedure Act and the elusive meaning of discretion itself. The author demonstrates the "disintegration" of administrative law and what he sees as the failure of its general precepts to accommodate immigration issues. This Article presents objective data and analysis regarding the components of California's population growth. It also reviews fiscal impacts from immigration. The author finds that these fiscal impacts are substantially negative for state and local governments. The Article also examines United States workforce needs as they may be affected by an expanding population and as they may implicate immigration. The author recommends changing immigration policy to focus more on workforce needs and skills in California. This Article analyzes the development of entry as an immigration concept, with special attention to those factors that affect entry analysis. These elements that the author finds must be considered in every potential entry into the United States are: (1) the legal status of the alien, (2) the purpose for finding an entry, and (3) the congressional intent behind the statutes involved. This Article explores the legal history of the term "entry," and illustrates the interaction of the three factors above. Budget Policy And Fiscal Crisis: A Political Matrix, Francis J. Leazes Jr., Robert Sieczkiewicz

A study of 134 Rhode Island programs, administered during the state's budget crisis in the fiscal years 1987 to 1991, yielded a number of important lessons. The more mandated formula spending there was in a budget, the more uncontrollable was the budget. There is a spending bias ingrained in the political culture. Some nonentitlement spending can be difficult to curtail. Cutback management strategies are inadequate to address significant revenue shortfalls. The recent discovery that an anonymously published 1620 essay was an early writing of Thomas Hobbes invites investigation of his early thinking. Hobbes relied on mostly classical sources to advance a basically conventionalist theory of law and to anticipate twentieth century analyses of the principles of rule of law such as that made famous by F. A. Hayek.

Japan has maintained a low profile in its diplomacy since the end of World War II, relying heavily on the United States for its security and prosperity. The cold war structure allowed Japan to maintain its passive foreign policy behavior. By the end of 1980s, West-East confrontations largely ended and global issues such as arms control, environmental problem, human rights, economic development, and ethnic conflicts became the main international concerns. Many studies concerning multinational corporations (MNCs) are replete with theoretical models and case studies that treat MNCs as stand-alone entities. Very little time and effort is given to understanding the context in which MNCs operate. This context includes not only the fact that MNCs transcend national boundaries (political as well as geographical), but also the meaning of work and being part of a multinational work force for those employed within MNCs. Employing Alexander George's method of structured, focused comparison of cases, this study identifies patterns of Congressional action when the use of American armed forces was at stake. Common explanations for the reluctance of Congress in assuming its constitutional role in the initiation of armed conflicts stress concerns over political costs of a Congressional involvement, namely the so called rally-effect, and existing policy consensuses.

This paper examines the executive-legislative relations on foreign policy formulation, debate, authorization, funding and implementation. The research shows that the founding fathers never intended one branch to totally control the "war powers." Inter-branch rivalry and conflict were intended.

The research establishes a pattern this inter-branch relationship has taken since the Constitutional Convention. This "pattern" clearly indicates the natural ability of the executive branch in handling foreign affairs especially those key events involving the use of force or where the potential for violence exists.

This study focuses on the character attributes, philosophy, political skills, policy agenda, and administrative activities of William A. Ryan, Speaker of the Michigan House of Representatives from 1969 through 1974 and a House member from 1958 through 1982. The case study is embedded in a history of Michigan’s political culture, which is characterized by moralistic and individualistic strands often in conflict with one another.
