An Interdisciplinary Approach In Identifying The Legitimate Regulator Of Anti-Doping In Sport: The Case Of The Australian Football League, Lisa Gowthorp, Annette Greenhow, Danny O'Brien
Lisa Gowthorp
The regulation of anti-doping practices in Australian sport is overseen by the Australian Sports Anti-Doping Authority (ASADA), which is a statutory authority funded by the Australian Commonwealth Government (ACG). The 2013 ASADA investigation into the Essendon Football Club (EFC) uncovered the alleged use of performance and image enhancing drugs by a number of players and support personnel. However, despite the call for sanctions to be placed on those taking banned substances, ASADA itself became the central focus of enquiry with the EFC questioning the legitimacy of ASADA's authority in their management of the investigation. Using content analysis and Bourdieu's conceptual …

Collaborative Diagnosis: Interdisciplinary Problem-Solving Between Physicians And Lawyers, Robert Pettignano, Lisa Bliss, Sylvia Caley
Collaborative Diagnosis: Interdisciplinary Problem-Solving Between Physicians And Lawyers, Robert Pettignano, Lisa Bliss, Sylvia Caley
Sylvia B. Caley
Patient and client-centered practice and accurate problem diagnosis require that we understand the context within which the patient/clients’ problem originated. Effective problem solving depends upon context-specific solutions. This article describes the interaction of a medical clinician/educator and two legal clinicians/educators who work and teach together as part of an interdisciplinary community collaboration. We demonstrate how a pediatric hospital and two medical schools that treat acutely and chronically ill children collaborate with a legal services clinic based in a law school to provide interdisciplinary clinical education for students and engage in interdisciplinary problem solving for the benefit of patients and clients. …

Brazil has introduced a referendum regarding the prohibition of firearm commerce and propaganda arguments has invoked socially and personally driven issues in the promotion of voting in favor of and against firearm control, respectively. Here, we used different techniques to study the brain activity associated with a voter’s perception of the truthfulness of these arguments and their influence on voting decisions. Low Resolution Tomography was used to identify the possible different sets of neurons activated in the analysis of the different types of propaganda. Linear correlation was used to calculate the amount information provided by different electrodes about how these …
Regulating The Placebo Effect In Clinical Practice, Tracey Chan
Regulating The Placebo Effect In Clinical Practice, Tracey Chan
Tracey E Chan
Recent research and ethical analysis have forced a clinical and ethical reappraisal of the utility of placebos in medical practice. The main concern of ethics and law is that using placebos in health care involves deception, which is antithetical to patient autonomy and trust in the physician-patient relationship. This paper reviews the various, more nuanced scientific conceptions of the placebo effect, and evaluates the ethical and legal objections to deploying placebos in clinical practice. It argues that the placebo effect may be legitimately accommodated on the basis that it does not engage the requirement for material or quasi-fiduciary disclosures of …

Liberalizing Nirvana: An Analysis Of The Consequences Of Common Pool Resource Deregulation For The Sustainability Of Fiji’S Surf Tourism Industry, Jess Ponting, Danny O'Brien
Liberalizing Nirvana: An Analysis Of The Consequences Of Common Pool Resource Deregulation For The Sustainability Of Fiji’S Surf Tourism Industry, Jess Ponting, Danny O'Brien
Danny O'Brien
In July 2010, the Fijian government issued a decree that liberalized Fiji’s surf breaks and deregulated its surf tourism industry. It did this by canceling licenses that granted resorts exclusive use of surf breaks based on indigenous customary ownership of foreshore and fringing reef fishing areas as common pool resources. This paper analyses the sustainability of surf tourism in Fiji, utilizing a developing framework for sustainable surf tourism. Based on broader sustainable tourism theory and empirical research, the framework considers (1) the impact of economic neo-liberalism, (2) the need for coordinated planning and limits to growth, (3) the advantages of …

Positron Emission Tomography (PET) is a medical imaging technique that can be used to show brain function. Courts have admitted PET scan evidence in cases involving brain damage, injury, toxic exposure, or illness ("brain trauma") and to support claims of diminished cognitive abilities and impulse control. Despite the limited data on the relationships between PET, brain trauma and behavior, many courts admit PET scan evidence without much critical analysis. This article examines the use of PET as proof of functional impairment and justification of abnormal behavior by explaining its diagnostic use and limitations, the limited support for claims of its …
Prevention Of Fatal Opioid Overdose, Leo Beletsky
Prevention Of Fatal Opioid Overdose, Leo Beletsky
Leo Beletsky
Opioid overdose is a burgeoning public health crisis, accounting for at least 16,000 deaths annually in the United States. Opioid overdose occurs across sex, ethnic, age, and geographic strata and involves both medical and nonmedical opioid use. To date, federal government response has focused primarily on monitoring and securing the drug supply. This Viewpoint suggests various steps necessary to support a more comprehensive approach.

Hiv And Women: Incongruent Policies, Criminal Consequences, Aziza Ahmed
Aziza Ahmed
The new agency UN WOMEN must play an active role in the standardization of laws and policies at the global and national level where their incongruence has negative and often criminal consequences for the health and lives of women and girls. This article focuses in on three such examples: opt-out testing for HIV, criminalization of vertical transmission, and the new World Health Organization guidelines on breastfeeding.

Michael J. Malinowski
This article addresses the impact of integration of academia, industry, and government on the public nature of research. The article concludes that, while the integration has benefited science immensely, regulatory measures should be taken to restore the public nature of research in an age of integration.

A Case Of Health Disparity, Donna Zucker

Although the incidence of hepatitis C virus (HCV) in women is only slightly less than in men, women are poorly represented in research trials. As a result, not much is known about them as a subgroup. The specific aims of this article were to report on the problem, study methods, and findings focusing on HCV-positive women's health beliefs, how they identify and understand their health and illness states, and their explanatory models of illness behavior. A pilot study using three focus groups was conducted with women in the community, in recovery, and incarcerated. Two groups emerged: those with and those …

Female And Male Student Athletes' Perceptions Of Career Transition In Sport And Higher Education: A Visual Elicitation And Qualitative Assessment, C. Keith Harrison
Dr. C. Keith Harrison
The termination of a collegiate athletic career is inevitable for all student athletes. The purpose of this study was to explore student athletes’ perceptions of the athletic career transition process. One-hundred-andforty- three (n = 143) National Collegiate Athletic Association (NCAA) Division II student athletes were administered the Life After Sports Scale (LASS) designed by the authors. The LASS is a 58-item mixed method inventory. The scope of this inquiry explored the qualitative section, which examined participants’ perceptions that were visually primed with a narrative description of a student athlete who made the transition out of collegiate sport successfully. Three major …
