The Legal Roles And Responsibilities Of A Community Concerning Crop Depredation By White-Tailed Deer, Eric G. Darracq, Stephen R. Chapman

Wildlife Damage Management Conference

The interwoven issues of the legal roles and responsibilities that landowners (i.e., farmers, foresters, and hunters) and a state agency have to control deer densities in rural areas that directly affect crop depredation and various stakeholders will be addressed in this paper. Because unmanaged deer populations severely can damage agricultural crops, the financial cost of this deer damage is borne entirely by individual private landowners. The South Carolina Department of Natural Resources (SCDNR) is the regulatory state agency in South Carolina responsible for annually promulgating rules and regulations pertaining to white-tailed deer harvest by hunters. Patents on human genetic information have been controversial among different groups for different reasons. The purpose of a patent system is to motivate the commercial development of new technologies; it is thus unsurprising that those who have fundamental misgivings about commercial biotechnology would oppose gene patents. More intriguing is the controversy over gene patenting among those who welcome the commercial development of biotechnology products by private firms. While many proponents of commercial biotechnology assert that gene patents are essential to motivate product development, some have expressed more nuanced views, endorsing patents under some circumstances and condemning them as unnecessary or …

This article discusses how the rules affecting the use of surface water ground water in a typical riparian state, Indiana, can promote the conservation biological diversity. The article first surveys the basic water laws that apply to surface water, diffused surface water, underground streams, and ground water. The rules governing the uses of these waters originate in common law property doctrines and substantially clarified by state legislation. Next the article considers state administration of water.
