Multimodal Transportation Under The Rotterdam Rules: Legal Implications For European Carriage Of Goods And The Quest For Uniformity, Olena Bokareva

Olena Bokareva

The increase in intercontinental trade and the modernization of transport infrastructure has transformed the traditional patterns of carriage of goods globally. The transportation by land precedes and follows the sea carriage. These developments led to the growing use of multimodal transportation, which simplifies the door-to-door delivery of goods by different modes of transport under a single contract. The existing transport conventions deal with one specific mode of transport, such as sea, rail, air and inland waterways, while an international mandatory convention related to multimodal transportation is lacking. The previous attempts to create an international legal instrument to govern this type …

Liability For Delay In Multimodal Transport Under The Rotterdam Rules, Olena Bokareva

Olena Bokareva

Delay in commercial law is a multifaceted subject involving many aspects. In carriage of goods based on a sale contract, late delivery of goods might have serious legal and commercial implications. Added to this verity, the consequences of delay are more problematic when goods are carried by different modalities. The delivery time of goods in multimodal transport is becoming increasingly crucial. This is largely due to the “just in time” concept which requires not the fastest delivery of goods but rather delivery at the expected time. It is well recognised that unlocalised loss or damage is a major problem in …

Liability For Delay In Multimodal Transport Under The Rotterdam Rules, Olena Bokareva

Olena Bokareva

Liability for delay is a topical issue in the law of carriage of goods mainly because not much scholarly work has been devoted to it. The probable reason is because there are no provisions in the Hague-Visby Rules adressing delay. This article looks at liability for delay in respect of carriage under unimodal Conventions and then focuses on the Rotterdam Rules where liability for delay is covered. The author concludes that provisions pertaining to liability for delay are not adequately harmonised in transport law nor in multimodal transportation in particular.

Multimodal Transportation In Eastern Europe: A Ukrainian Legislative Perspective, Olena Bokareva, Proshanto Mukherjee

Olena Bokareva

Multimodal transportation in the European continent is an integral part of cross border trade and in particular the use of sea and river carriers. The phenomenon of short sea shipping has reached a level of importance of which all European states must take cognisance. One of the policies associated with this issue is the development of the motorways of the sea. While Ukraine is not yet a part of the European Union (EU), it aspires to become a member; and in any event, it is physically a part of the European continent. It shares this attribute with other East European …

Multimodal Maritime Plus: Some European Perspectives On Law And Policy, Olena Bokareva, Proshanto Mukherjee

It is an understatement to say that shipping plays an important role for the European Union (EU) and its member States given that over ninety percent of the Union’s foreign trade is transported by sea. It is conspicuous that in recent years the size of the EU fleet has increased considerably. As a part of the EU’s Common Transport Policy, the EU has also developed its own shipping policy elements of which continue to engender concerns in certain quarters given that shipping is largely a global activity. Be that as it may, a number of EU projects such as Short …
