Beyond Admissions: Racial Equality In Law Schools, Sharon E. Rush

Beginning with a discussion of the United States Supreme Court’s decision in McLaurin v. Oklahoma State Regents for Higher Education, this article discusses the meaning of “integration.” In McLaurin, the University of Oklahoma was forced to abandon its segregation policy and not separate black students from their white classmates in all settings (not just the classroom). The McLaurin decision raised the fundamental questions: "What is integration?" and "How is integration related to racial equality?" Significantly, the McLaurin Court clarifies that equality is premised on integration and that integration means more than just having a presence in an institution. …

Rules, Story And Commitment In The Teaching Of Legal Ethics, Susan P. Koniak, Roger C. Crampton

The ABA requires each "approved" law school to provide each student "instruction in the duties and responsibilities of the legal profession." First adopted in August, 1973, in the midst of the Watergate disclosures, this requirement has never been interpreted and is infrequently referred to or enforced in the accreditation process. The professional responsibility requirement is the only substantive teaching requirement imposed by the ABA.
Should the ethics teaching requirement be scrapped? We consider that question in Part I. Although we ultimately conclude the rule should be maintained, we believe this fundamental question must be asked. Given the disdain many legal …

The casebook method of teaching is, in fact, an exercise in futility. It is the students themselves who are expected to build up a picture of law from the few generally disconnected scraps available to them and with virtually no tools. Students are left to guess what the editors' view of the law is rather than getting to what the law is all about. The Impact Of The Americans With Disabilities Act On Legal Education And Academic Modifications For Disabled Law Students: An Empirical Study, Donald H. Stone
All Faculty Scholarship
Law schools face the challenge of providing disabled students with reasonable accommodations in their academic setting in a fair and equitable manner. Disabled law students continue to demand academic modifications in course examinations by claiming to be persons with mental or physical disabilities. Law schools are also beginning to see requests for extension of time for degree completion, priority in course registration, and authorization to tape record classes, all by virtue of an entitlement under the mandates of the Americans with Disabilities Act (ADA).
Persons with a wide range of disabilities are seeking academic modifications from their law schools. What …
