Quem Defende A Constituição?, Paulo Ferreira Da Cunha Dec 2011

Quem Defende A Constituição?, Paulo Ferreira Da Cunha

A Constituição Laboral Em Alto Risco, Paulo Ferreira Da Cunha Dec 2011

A Constituição Laboral Em Alto Risco, Paulo Ferreira Da Cunha

Moral Limits On Morals Legislation: Lessons For U.S. Constitutional Law From The Declaration On Religious Freedom, Gregory A. Kalscheur S.J. Dec 2011

Moral Limits On Morals Legislation: Lessons For U.S. Constitutional Law From The Declaration On Religious Freedom, Gregory A. Kalscheur S.J.

Gregory A. Kalscheur, S.J.

A persistent American confusion regarding the proper relationship between law and morality is manifest in the opinions in Lawrence v. Texas. The Second Vatican Council’s Declaration on Religious Freedom provides the foundation for an analytical framework that can bring clarity to that confusion. The heart of this framework is the moral concept of public order. This concept offers a principled explanation of both the holding in Lawrence and the limitations the Court placed on that holding. The Court could clarify the confusion manifest in Lawrence by explicitly acknowledging that a state interest only becomes legitimate for purposes of rational ...

This report documents the study design, methodology, analysis, and results for a study on the exercise of peremptory challenges during jury selection in trials of all defendants on death row in North Carolina as of July 1, 2010. The study examined how prosecutors exercised peremptory challenges in capital cases to assess whether potential jurors’ race played any role in those decisions. The primary investigators for the study are Barbara O’Brien and Catherine Grosso. Both are associate professors of law at Michigan State University College of Law.

Inconstitucionalidade Da Abolição De Feriados, Paulo Ferreira Da Cunha Dec 2011

Inconstitucionalidade Da Abolição De Feriados, Paulo Ferreira Da Cunha

Antitrust's "Jurisdictional" Reach Abroad, Herbert J. Hovenkamp Dec 2011

Antitrust's "Jurisdictional" Reach Abroad, Herbert J. Hovenkamp

Faculty Scholarship at Penn Law

In its Arbaugh decision the Supreme Court insisted that a federal statute’s limitation on reach be regarded as “jurisdictional” only if the legislature was clear that this is what it had in mind. The Foreign Trade Antitrust Improvement Act (FTAIA) presents a puzzle in this regard, because Congress seems to have been quite clear about what it had in mind; it simply failed to use the correct set of buzzwords in the statute itself, and well before Arbaugh assessed this requirement.

Even if the FTAIA is to be regarded as non-jurisdictional, the constitutional extraterritorial reach of the Sherman Act ...

Referendar Estados De Excepção, Paulo Ferreira Da Cunha Dec 2011

Referendar Estados De Excepção, Paulo Ferreira Da Cunha

Langdell And The Invention Of Legal Doctrine, Catharine Wells Dec 2011

Langdell And The Invention Of Legal Doctrine, Catharine Wells

Catharine P. Wells

This paper addresses two related questions. The first relates to Langdell and his development of a doctrinal theory of contract law. The substance and method of Langdell’s work has not been well understood and this paper uses a variety of historical materials to remedy this problem. It begins with a review of contract law prior to Langdell. Contract law at this time was in a very primitive state. The available treatises were confusing and the cases themselves offered little guidance for predicting future case outcomes. The paper then proceeds to examine Langdell’s method by describing certain logic texts ...

Churches, Charities And Corrective Justice: Making Churches Pay For The Sins Of Their Clergy, Catharine Pierce Wells Dec 2011

Churches, Charities And Corrective Justice: Making Churches Pay For The Sins Of Their Clergy, Catharine Pierce Wells

Catharine P. Wells

The Catholic Archdiocese of Boston faced the threat of large tort judgments as a result of acts of sexual abuse committed by its priests. Because the Archdiocese is a public charity, it has been suggested that the Archdiocese could invoke the Massachusetts charitable immunity statute, which in certain circumstances places a $20,000 cap on the tort liability of a charitable organization. This Article explores the role of charitable organizations in our culture, and the distinctive type of state oversight to which they are subject. It then discusses various rationales for the doctrine of charitable immunity. The Article determines that ...

The Hollowness Of The Harm Principle, Steven D. Smith Dec 2011

The Hollowness Of The Harm Principle, Steven D. Smith

Steven D. Smith

Among the various instruments in the toolbox of liberalism, the so-called “harm principle,” presented as the central thesis of John Stuart Mill’s classic On Liberty, has been one of the most popular. The harm principle has been widely embraced and invoked in both academic and popular debate about a variety of issues ranging from obscenity to drug regulation to abortion to same-sex marriage, and its influence is discernible in legal arguments and judicial opinions as well. Despite the principle’s apparent irresistibility, this essay argues that the principle is hollow. It is an empty vessel, alluring but without any ...

The Tenuous Case For Conscience, Steven D. Smith Dec 2011

The Tenuous Case For Conscience, Steven D. Smith

Steven D. Smith

If there is any single theme that has provided the foundation of modern liberalism and has infused our more specific constitutional commitments to freedom of religion and freedom of speech, that theme is probably “freedom of conscience.” But some observers also perceive a progressive cheapening of conscience– even a sort of degradation. Such criticisms suggest the need for a contemporary rethinking of conscience. When we reverently invoke “conscience,” do we have any idea what we are talking about? Or are we just exploiting a venerable theme for rhetorical purposes without any clear sense of what “conscience” is or why it ...

La Voluntad En Los Contratos De Adhesión: Sociología Y Crítica Jurídica, Con Énfasis En El Análisis Económico Del Derecho / The Consent Theory Critique And Standard Form Contracts In Civil Law (With Special Reference To Law And Economics), Andres Palacios Lleras Dec 2011

La Voluntad En Los Contratos De Adhesión: Sociología Y Crítica Jurídica, Con Énfasis En El Análisis Económico Del Derecho / The Consent Theory Critique And Standard Form Contracts In Civil Law (With Special Reference To Law And Economics), Andres Palacios Lleras

The purpose of this paper is to explore the ...

Desafios Constitucionais, Paulo Ferreira Da Cunha Nov 2011

Desafios Constitucionais, Paulo Ferreira Da Cunha

Holmes And Dissent, Allen P. Mendenhall Nov 2011

Holmes And Dissent, Allen P. Mendenhall

Allen Mendenhall

Holmes saw the dissent as a mechanism to advance and preserve arguments and as a pageant for wordplay. Dissents, for Holmes, occupied an interstitial space between law and non-law. The thought and theory of pragmatism allowed him to recreate the dissent as a stage for performative text, a place where signs and syntax could mimic the environment of the particular time and place and in so doing become, or strive to become, law. Holmes’s dissents were sites of aesthetic adaptation. The language of his dissents was acrobatic. It acted and reacted and called attention to itself. The more provocative ...

Electronic Contracts In Tanzania: An Appraisal Of The Legal Framework, Daudi Mwita Nyamaka Mr.

Daudi Mwita Nyamaka Mr.

The concern of our study was to examine the legal basis for electronic contracts in Tanzania. The major problems that were being examined are; the ascertainment of e-contract terms and the other party in the contract with the focus to consent i.e. consensus ad idem requirements and capacity to contract. With the first problem, e-commerce involves e-contracts and the business community in Tanzania enters into contractual arrangements with external world via websites or email in which case the electronic environment is not suitable in Tanzania in terms of the laws and the technology. Messages sent via internet may be ...

Direito E Poder Em Nietzsche, Paulo Ferreira Da Cunha Nov 2011

Direito E Poder Em Nietzsche, Paulo Ferreira Da Cunha

Truth In Law, Andrei Marmor Nov 2011

Truth In Law, Andrei Marmor

University of Southern California Legal Studies Working Paper Series

In this essay I offer a speech act analysis of truth evaluable content of legal prescriptions. The argument is based on two main frameworks: one, drawn from an analogy with truth in fiction, explains the prefixed nature of legal statements, and the second explores the propositional content of legal prescriptions as a species of exhortative speech acts. Overall, the essay suggests an interpretation of legal prescriptions that allows for the validity of standard legal syllogisms.

30 = 20: ‘Understanding’ Maximum Sentence Enhancements, Frank R. Herrmann S.J. Nov 2011

30 = 20: ‘Understanding’ Maximum Sentence Enhancements, Frank R. Herrmann S.J.

Frank R. Herrmann, S.J.

In this article, Professor Herrmann argues that the due process protections of a criminal trial should apply to aggravating factors that under current “maximum-enhancing statutes” allow judges to impose lengthier punishments in the sentencing phase. Part I considers the Supreme Court's rationale for refusing to apply full due process safeguards to all types of sentencing schemes. This background will reveal the unique quality of maximum-enhancing statutes and establish why the due process protections of a criminal trial should apply to sentencing under maximum-enhancing statutes. Part I, therefore, undertakes to explain courts' rationales to deny criminal defendants full criminal due ...

The Rubber Bands Are Broken; Opening The ‘Punctualized’ European Administration Of Justice, Paul Van Den Hoven Nov 2011

The Rubber Bands Are Broken; Opening The ‘Punctualized’ European Administration Of Justice, Paul Van Den Hoven

Paul van den Hoven

In this paper the speculative thesis is explored that in our era of digital connectivity, the remarkable capacity of a legal institution to absorb a huge amount of social dynamics as if it is a priori already present in a closed, ‘punctualized’ institution , leads to a serious loss of public legitimacy. The main argument is that such response to alternative, ‘rich’ narratives isolates the institution in an era in which digital technology creates actants that make such isolation untenable.

The Accession Insight And Patent Infringement Remedies, Peter Lee Nov 2011

The Accession Insight And Patent Infringement Remedies, Peter Lee

Michigan Law Review

What is the appropriate allocation of rights and obligations when one party, without authorization, substantially improves the property of another? According to the doctrine of accession, a good faith improver may take title to such improved property, subject to compensating the original owner for the value of the source materials. While shifting title to a converter seems like a remarkable remedy, this outcome merely underscores the equitable nature of accession, which aims for fair allocation of property rights and compensation between two parties who both have plausible claims to an improved asset. This Article draws upon accession-a physical property doctrine ...
