The Dmca Rulemaking Mechanism: Fail Or Safe?, Maryna Koberidze

This Article analyzes seventeen years under the Digital Millennium Copyright Act (“DMCA”) rulemaking mechanism and suggests changes to reinforce its successes while remedying its failures. Part I briefly discusses the legislative history of the rulemaking mechanism and policy justifications for its adoption within the DMCA scheme. Part II reviews legal and evidentiary standards of the rulemaking and recent changes to its administrative procedure. Part III provides an overview of the prior rulemakings and their impact on non-infringing uses, with a particular focus on the “e-book” and “cellphone unlocking” exemptions. Ncaa Athletes, Unpaid Interns And The S-Word: Exploring The Rhetorical Impact Of The Language Of Slavery, Maria Ontiveros

This essay presents initial results of a literature survey that explored the use of the rhetoric of slavery by workers' rights groups. It presents quantitative results for uses of terms such as slave, slavery, modern day slavery, plantation, Jim Crow and Juan Crow as these terms were used by immigrant worker advocates, opponents of labor trafficking, advocates for unpaid interns, National Collegiate Athletic Association athletes, professional athletes and in the context of prison labor. For a county with a small population, a remote location and an awkward colonial past, Australia has a remarkable record of success in international sport, so much so that sport is often considered a ‘religion’ in the ‘Lucky Country’. If diplomacy is the business of representation, it would be expected that sport features prominently in Australia’s diplomacy. Steve Bechler, a pitcher in the Major Leagues, died as a result of ingesting a defective weight-loss product in spring training. His wife and daughter filed suit against the pharmaceutical company. Bechler had only pitched a few games in the Major Leagues, but was slotted as a starting pitcher for the Baltimore Orioles for the 2003 campaign. How do you calculate what Bechler would have earned in his Major League career? In this article, Professor Roger Abrams uses the techniques of baseball salary arbitration and publicly available salary and performance data to calculate the loss. He first constructs a group …
