Georgia State University Law Review

The Act gives the superior court jurisdiction over family violence proceedings when the victim resides in the jurisdiction or when the act occurs in the jurisdiction, regardless of where the offender resides, as long as personal jurisdiction is otherwise satisfied. This Act assigns the State Commission on Family Violence to the Administrative Office of the Courts for administrative purposes only. In addition, the Act makes it a misdemeanor to knowingly reveal the location of a family violence center.

Interprovincial Sovereign Immunity Revisited, Janet Walker

The conventional wisdom has been that the Canadian provincial Crowns are immune from the jurisdiction of the courts of other Canadian provinces just as they are immune from the jurisdiction of foreign courts. This reflects the old views that the provinces are like foreign countries for the purposes of the conflict of laws and that court jurisdiction over the Crown is purely a creature of statute. Recent recognition of the constitutional bases for court jurisdiction and the need to reassess conflict of laws rules in light of the principles of Canadian federalism invites us to revisit interprovincial sovereign immunity, especially …

Internet Jurisdictional Issues: Fundamental Fairness In A Virtual World, Karin M. Mika, Aaron J. Reber

This Article explains Internet jurisdictional issues within the current framework that enables a state to assert in personam jurisdiction. This Article argues that existing jurisdictional tests are appropriate in determining the fairness of jurisdiction in cases involving the Internet, despite the vast outreach capacity of computers. This Article will first examine the development of law concerning in personam jurisdiction. Next, this Article will reflect on how courts have handled jurisdictional issues respecting other modes of communication, namely the mail and telephone. More than one thoughtful business manager has contemplated the prospect of litigation abroad in terms analogous to those used by the 19th century diarist quoted above. When an international venture goes awry, the dramatically disagreeable consequences can often include the "hometown justice" of the other side's national courts: unfamiliar procedures, perhaps a foreign language, and in some countries, a xenophobic or even corrupt judge.
