This Article challenges the various jurisdictional theories that underpin the FCC’s net neutrality regulation. The assertion of jurisdiction by the FCC over any aspect of the Internet ecosystem has raised populist, congressional, and even judicial rhetoric to a crescendo and resulted in a recent vote to defund the FCC’s efforts. This Article places the current crisis squarely in the context of the long-standing jurisdictional struggle between regulation and antitrust law. These two regimes are often at jurisdictional cross-purposes because, even though they both purport to maximize the social good, they do so by inapposite means. Indeed, there is a policy …

Textiles and Clothing (T&C) is a critically important sector of international trade for developing countries and least developed countries (LDCs). The T&C sector engages abundant labour resources and requires low investment threshold. The T&C sector has been a contentious area in multilateral trade negotiations. With the expiration of quotas in 2005, many T&C dependent countries are experiencing considerable adjustment challenges. Pakistan is one such country that is extensively reliant on T&C industries. This research note presents a brief case study which looks at post-quota developments in Pakistan's T&C trade and the trade and economic policy issues it raises.

Unraveling The Chicago/Harvard Antitrust Double Helix: Applying Evolutionary Theory To Guard Competitors And Revive Antitrust Jury Trials, Thomas J. Horton

This paper addresses the Supreme Court's current favorable view of monopolies and strong antipathy toward antitrust jury trials. The current Chicago/Harvard philosophical antitrust double helix is built around the ideas that monopolies are generally efficient and procompetitive while juries are unable to grasp complex antitrust economics. Building upon evolutionary analyses in previous papers, this article recommends a new philosophical antitrust double helix that will generate increased enforcement of and compliance with the language and spirit of sections 2 of the Sherman Act and 7 of the Clayton Act. Judge Breyer famously worried that aggressive prohibitions of predatory pricing throw away a bird in hand (low prices during the alleged predatory period) for a speculative bird in the bush (preventing higher prices thereafter). Here, I argue that there is no bird in hand because entry cannot be presumed. Moreover, it is plausibly commonplace that low prices or the threat of low prices produce anticompetitive results by reducing entry, inducing exit, and keeping prices high. I analyze three potential standards for identifying predatory pricing. Two are traditional but have been tangled together and must be distinguished. First, a price-cost test …
