Professionalism Videos, Mary Ann Robinson, Alison Kehner
Professionalism Videos, Mary Ann Robinson, Alison Kehner
Mary Ann Robinson
A series of short filmed vignettes to be used to teach law students about concepts of professionalism. They are intended to be used to help our students realize that their careers as lawyers commence in law school, and that they must begin to adopt and emulate standards of professionalism in law school that they will carry with them when they become legal professionals. Choices made now not only impact their professional reputations, but also establish patterns that can serve them for the better or for the worse in practice.

Nuclear Containment For The Twenty-First Century; A Mandatory Nuclear Forensics Data Bank, Jack Garvey
Jack I Garvey
This article is a response to the challenge of nuclear non-proliferation for the 21st century. It describes the new landscape of nuclear risk and explains the role that the extraordinary developments in nuclear forensics science can play in generating an expansive deterrence to improve nuclear security by governments, and diminish the nuclear risk presented by terrorists and other non-state actors. Exploring the potential of nuclear forensics science, it provides the analysis to understand why that potential is not being realized. The article then proposes, as a practical and achievable foundation for a new and expansive deterrence, the establishment of an …

The Persistence Of Low Expectations In Special Education Law Viewed Through The Lens Of Therapeutic Jurisprduence, Richard Peterson
The Persistence Of Low Expectations In Special Education Law Viewed Through The Lens Of Therapeutic Jurisprduence, Richard Peterson
Richard Peterson
For more than thirty-five years a paradigm of low expectations has infected efforts to educate children with disabilities and has been a persistent and stubborn obstacle to the successful implementation of the Individuals with Disabilities Education Act (IDEA), and its predecessor, the Education of All Handicapped Children Act (EAHCA). This dilemma raises questions addressed in this paper: What is meant by low expectations in the context of Special Education Law? What are the root causes of this phenomenon, and what makes it so resistant to change? How does it impede implementation of the IDEA? And lastly, in what ways does …
The People's Agents And The Battle To Protect The American Public, Rena Steinzor, Sidney Shapiro
The People's Agents And The Battle To Protect The American Public, Rena Steinzor, Sidney Shapiro
Rena I. Steinzor
Reasonable people disagree about the reach of the federal government, but there is near-universal consensus that it should protect us from such dangers as bacteria-infested food, harmful drugs, toxic pollution, crumbling bridges, and unsafe toys. And yet, the agencies that shoulder these responsibilities are in shambles; if they continue to decline, lives will be lost and natural resources will be squandered. In this timely book, Rena Steinzor and Sidney Shapiro take a hard look at the tangled web of problems that have led to this dire state of affairs.
It turns out that the agencies are not primarily to blame …
Shari’Ah And Choice: What The United States Should Learn From Islamic Law About The Role Of Victims’ Families In Death Penalty Cases, Susan Hascall
Shari’Ah And Choice: What The United States Should Learn From Islamic Law About The Role Of Victims’ Families In Death Penalty Cases, Susan Hascall
Susan C. Hascall
Under classical Islamic law, homicide is considered an individual wrong. As such, the family members of the victim have the right to choose the punishment that is to be imposed. They may choose to have the offender put to death. Or they may choose to collect a fine from the convicted person and his or her family. They may even choose to forgive the convicted person without exacting any fine. This last option is encouraged and based on Qur’anicc text. In the United States, however, courts do not allow the family members of a murder victim to even voice an …
Local Participatory Democracy In Israel: Toward A Digital Era, Jennifer Shkabatur
Local Participatory Democracy In Israel: Toward A Digital Era, Jennifer Shkabatur
Jennifer Shkabatur
Numerous Israeli cities are amidst a participatory and economic crisis. The gist of the Article is that stronger citizen participation in municipal affairs can help mitigate the crisis, and that digital technologies should play a central role in this endeavor. As the use of digital technologies is still largely uncommon in this context, the Article contends that an effective institutional design for digital platforms is particularly important. Hence, the Article suggests criteria for the evaluation of digital participatory initiatives and develops two models of online citizen participation—consumerist and co-productive. Relying on a variety of American, German, and Israeli examples, the …
The Upside Of Baby Markets, Martha Ertman
The Upside Of Baby Markets, Martha Ertman
Martha M. Ertman
Few think there is an upside to baby markets. This chapter challenges conventional wisdom by suggesting that marketizing parenthood through the sale of gametes and other reproductive technologies facilitates family formation by single and gay people. After briefly reviewing literature, it defends commercialization of human eggs and sperm and applies those defenses to embryo markets.

Legal Questions And Scientific Answers: Ontological Differences And Epistemic Gaps In The Assessment Of Causal Relations, Lena Wahlberg
Legal Questions And Scientific Answers: Ontological Differences And Epistemic Gaps In The Assessment Of Causal Relations, Lena Wahlberg
Lena Wahlberg
A large number of legal rules create an obligation to prevent, repair or otherwise mitigate damage to human health or the environment. Many of these rules require that a legally relevant causal relation between human behaviour and the damage at issue is established, and in the establishment of causal relations of this kind scientific information is often pressed into service. This thesis examines this specifically legal use of scientific information. It shows that many legally relevant causal relations cannot be established in this way. It also shows that the legal strategy for dealing with epistemic difficulties (uncertainty and ignorance) by …

The Inherent Structure Of Free Speech Law, Joshua Davis, Joshua
Joshua P. Davis
To date no one has discovered a set of organizing principles for free speech doctrine, an area of the law that has been criticized as complex, ad hoc, and even incoherent. We provide a framework that distills free speech law down to three judgments: the first about the role of government; the second about the target of government regulation; and the third a constrained cost-benefit analysis. The framework can be summarized by three propositions: first, the Constitution constrains government if it regulates private speech, but not if government speaks, sponsors speech, or restricts expression in managing an internal governmental function; …
