This theory, deriving from Macauley's implications, but structured and analysed by I.R. On 25 November 2009, the European Parliament and Council adopted a new legislation to revise the regulatory framework for the electronic communications sector. This new “package” of Directives includes Directive 2009/136/EC, which amends earlier Directive 2002/58/EC in the fields of 1. mandatory notification of personal data security breaches 2. consent requirements for cookies and 3. anti-spamming measures by ISPs. In India, the consumer movement began to develop in the 1960s though it took its shape in the late 1980’s. In 1982, an ‘Asian Seminar in Consumer Protection’ was organized in schools and colleges, in which 300 delegates from all the Asian Countries participated. Taking this landmark consumer movement into consideration, the then Prime Minister Indira Gandhi included Consumer Protection as the 17th programme and it was put on the national agenda. For the first time, the need to create a statute for the protection of the consumers was felt.

This paper discusses and critically examines the close interrelations of two of the main defences to liability in damages for torts and breach of contract. After a careful analysis of the various similarities between the doctrines of contributory (or comparative) negligence and mitigation of damages, and the basic difference between the two, the article reaches the conclusion that there is no justification for the ongoing existence of the mitigation doctrine. It should be abolished, and the doctrine of comparative negligence should be adopted across the board in both tort law and contract law.

Biometric identification techniques such as retinal scanning and fingerprinting have now become commonplace, but near-future improvements on these methods present troubling issues for personal privacy. For example, retinal scanning can be used to diagnose certain medical conditions, even ones for which the patient has no symptoms or has any other way of detecting the problem. If a health insurance company scans the retinas of potential clients before they purchase coverage, they could be charged higher premiums for conditions that do not present any issues.
