Corporate Social Responsibility In China: Window Dressing Or Structural Change?, Li-Wen Lin Nov 2013

Corporate Social Responsibility In China: Window Dressing Or Structural Change?, Li-Wen Lin

Li-Wen Lin

In recent years many indigenous corporate social responsibility (CSR) initiatives have emerged in China. The Chinese CSR initiatives include laws and regulations, governmental instructions and guidelines, non-governmental standards and organizations. The recent growth of the Chinese CSR initiatives deserves an analysis of the CSRdevelopment in China, especially given that China’s international image is usually associated with human rights abuses, substandard products, sweatshops, and serious environmental pollution. How sincere and serious are the Chinese CSR measures, simply window dressing or any real structural change? This article overviews major Chinese CSR initiatives and analyzes the Chinese CSR development from the perspectives ...

Reducing The Impact Of Ethnic Tensions On Economic Growth – Economic Or Political Institutions?, Atin Basu Choudhary, Jim Bang, Michael Reksulak Oct 2012

Reducing The Impact Of Ethnic Tensions On Economic Growth – Economic Or Political Institutions?, Atin Basu Choudhary, Jim Bang, Michael Reksulak

James Bang

We use a standard growth regression model and show that ethnic tensions reduce per capita growth rates. We also find evidence that “good” economic and political institutions improve per capita growth rates. More importantly, good economic institutions mitigate the effect of ethnic tensions on per capita growth while good political institutions do not. Consequently, it is foremost capitalist freedom that promotes peace and development.

Não Uma Outra República, A Nossa República, Outra, Paulo Ferreira Da Cunha Dec 2010

Não Uma Outra República, A Nossa República, Outra, Paulo Ferreira Da Cunha

Recessions And The Social Safety Net: The Alternative Minimum Tax As A Counter-Cyclical Fiscal Stabilizer, Brian Galle, Jonathan Klick Dec 2010

Recessions And The Social Safety Net: The Alternative Minimum Tax As A Counter-Cyclical Fiscal Stabilizer, Brian Galle, Jonathan Klick

Faculty Scholarship

As recent events illustrate, state finances are procyclical: during recessions, state revenues crash, worsening the effects of economic downturns. This problem is well known, yet persistent. We argue here that, in light of predictable federalism and political economy dynamics, states will be unable to change this situation on their own. Additionally, we note that many possible federal remedies may result in worse problems, such as by creating moral hazard that would induce states to take on excessively risky policy, both fiscal and otherwise. Thus, we argue that policymakers should consider so-called “automatic” stabilizers, such as are found in the federal ...

The Disutility Of Injustice, Paul H. Robinson, Geoffrey P. Goodwin, Michael Reisig Dec 2010

The Disutility Of Injustice, Paul H. Robinson, Geoffrey P. Goodwin, Michael Reisig

Faculty Scholarship

For more than half a century, the retributivists and the crime-control instrumentalists have seen themselves as being in an irresolvable conflict. Social science increasingly suggests, however, that this need not be so. Doing justice may be the most effective means of controlling crime. Perhaps partially in recognition of these developments, the American Law Institute's recent amendment to the Model Penal Code's "purposes" provision – the only amendment to the Model Code in the 47 years since its promulgation – adopts desert as the primary distributive principle for criminal liability and punishment. That shift to desert has prompted concerns by two ...

Selling Knowledge: A Sociological Analysis Of Attorney Advertisement In Las Vegas, Giselle Velasquez Dec 2010

Selling Knowledge: A Sociological Analysis Of Attorney Advertisement In Las Vegas, Giselle Velasquez

UNLV Theses, Dissertations, Professional Papers, and Capstones

I analyze how Las Vegas attorneys represent themselves, their associates and clients in televised law firm commercials. I use attorney commercials as a case to explore cultural beliefs in media representations. Using an inductive method, I analyze the textual, visual, and aural symbols that appear most frequently in television commercials to interpret how law firm advertisements convey themes of attorney expertise, knowledge, ethnic and gender stereotyping. I introduce this study with a historical evaluation of the rise of advertisement in the United States. I continue discussing how the media is an important realm of discourse that affects people's identity ...

Dna Databases And Innocent Persons: Lessons From Scotland?, Liz Campbell Nov 2010

Dna Databases And Innocent Persons: Lessons From Scotland?, Liz Campbell

Liz Campbell

Databases of DNA samples are increasingly seen as a key element in the investigation of criminality, by providing a mechanism for detecting and resolving crimes effectively and expeditiously and by circumventing the need for new genetic tests of specific suspects in the context of each criminal inquiry. These factors, in addition to exonerative and deterrent effects, lend weight to the pragmatic argument that samples collected from all individuals who come to the attention of the police should be included in DNA databases, so as to enhance the likelihood of a successful match between a crime-scene sample and stored DNA. Holding ...

A Rights-Based Analysis Of Dna Retention: “Non-Conviction” Databases And The Liberal State, Liz Campbell Nov 2010

A Rights-Based Analysis Of Dna Retention: “Non-Conviction” Databases And The Liberal State, Liz Campbell

Liz Campbell

This article explores the implications for human rights of retaining a person’s DNA when there has been no conviction in the courts. The right to privacy, the presumption of innocence and the interest in not being stigmatised by the State are considered in turn, to determine if they pose a challenge to the retention of an innocent person’s genetic material.

Revisões Constitucionais Inconstitucionais?, Paulo Ferreira Da Cunha Nov 2010

Revisões Constitucionais Inconstitucionais?, Paulo Ferreira Da Cunha

Privacy Torts: Unreliable Remedies For Lgbt Plaintiffs, Anita L. Allen Oct 2010

Privacy Torts: Unreliable Remedies For Lgbt Plaintiffs, Anita L. Allen

Faculty Scholarship

In the United States, both constitutional law and tort law recognize the right to privacy, understood as legal entitlement to an intimate life of one’s own free from undue interference by others and the state. Lesbian, gay, bisexual, and transgender (“LGBT”) persons have defended their interests in dignity, equality, autonomy, and intimate relationships in the courts by appealing to that right. In the constitutional arena, LGBT Americans have claimed the protection of state and federal privacy rights with a modicum of well-known success. Holding that homosexuals have the same right to sexual privacy as heterosexuals, Lawrence v. Texas symbolizes ...

Palavras Claras, Paulo Ferreira Da Cunha Oct 2010

Palavras Claras, Paulo Ferreira Da Cunha

Quem assim fala, assim pensa. É critério infalível.

Lições Do Kiwi, Paulo Ferreira Da Cunha Oct 2010

Lições Do Kiwi, Paulo Ferreira Da Cunha

Forensic Science In Court: Challenges In The Twenty First Century (Issues In Crime And Justice), Hon. Donald Shelton Oct 2010

Forensic Science In Court: Challenges In The Twenty First Century (Issues In Crime And Justice), Hon. Donald Shelton

Hon. Donald E. Shelton

Forensic Science in Court explores the legal implications of forensic science—an increasingly important and complex part of the justice system. Judge Donald Shelton provides an accessible overview of the legal aissues, from the history of evidence in court, to "gatekeeper" judges determining what evidence can be allowed, to the "CSI effect" in juries. The book describes and evaluates various kinds of evidence, including DNA, fingerprints, handwriting, hair, bite marks, tool marks, firearms and bullets, fire and arson investigation, and bloodstain evidence. Assessing the strengths and limitations of each kind of evidence, the author also discusses how they can contribute ...

Protecting Indigenous Identity And Culture In The Modern Nation-State: A Case Study Of The Sami In Norway, Claire Lockerby Oct 2010

Protecting Indigenous Identity And Culture In The Modern Nation-State: A Case Study Of The Sami In Norway, Claire Lockerby

Independent Study Project (ISP) Collection

The plight of indigenous peoples around the world is a serious one, and without significant international action, many valuable cultural and linguistic traditions are in grave danger of disappearing altogether. Many of these indigenous groups have experienced detrimental consequences from the history of slavery, colonialism and imperialism, and the emergence of nation-states that stripped them of their autonomy and greatly threatened their way of life. Today, there are some positive examples of international and national efforts to protect indigenous peoples, but unfortunately, most indigenous populations remain dispossessed and underrepresented. Although the international community has established principles of unalienable human rights ...

The State-In-Society Approach To Democratization With Examples From Japan, Mary Alice Haddad Oct 2010

The State-In-Society Approach To Democratization With Examples From Japan, Mary Alice Haddad

Division II Faculty Publications

How does an undemocratic country create democratic institutions and transform its polity in such a way that democratic values and practices become integral parts of its political culture? This article uses the case of Japan to advocate for a new theoretical approach to the study of democratization. In particular, it examines how theoretical models based on the European and North American experiences have difficulty explaining the process of democratization in Japan, and argues that a state-in-society approach is better suited to explaining the democratization process diverse cultural contexts. Taking a bottom-up view of recent developments in Japanese civil society through ...

Realism, Punishment & Reform [A Reply To Braman, Kahan, And Hoffman, "Some Realism About Punishment Naturalism”], Paul H. Robinson, Owen D. Jones, Robert O. Kurzban

Professors Donald Braman, Dan Kahan, and David Hoffman, in their article "Some Realism About Punishment Naturalism," to be published in an upcoming issue of the University of Chicago Law Review, critique a series of our articles: Concordance and Conflict in Intuitions of Justice (http://ssrn.com/abstract=932067), The Origins of Shared Intuitions of Justice (http://.ssrn.com/abstract=952726), and Intuitions of Justice: Implications for Criminal Law and Justice Policy (http://.ssrn.com/abstract=976026). Our reply, here, follows their article in that coming issue. As we demonstrate, they have misunderstood our views on, and thus the implications of ...

El Futuro De La Inmigración En España - (“Future Of Immigration In Spain”), Joshua Bruno Oct 2010

El Futuro De La Inmigración En España - (“Future Of Immigration In Spain”), Joshua Bruno

Independent Study Project (ISP) Collection

The following argument is about the highly disputed theme of Immigration. Like all countries around the world, Spain manages a population of foreigners that have turned up in search of a new opportunity. If these migrants are able to enter the European Union, they still face many obstacles, including racism and extreme poverty. Yet, their contributions to a struggling European economy are undeniable. The following paper attempts to highlight these important contributions and demonstrate how in a liberal democratic society, such as Spain’s, a more accepting immigration policy where more sanitary conditions provided to immigrants could work. Furthermore, these ...

Bringing War Criminals To Justice And Justice To Victims: Mass Rape In Bosnia-Herzegovina And The Efficiency Of The Icty, Meredith Loken Oct 2010

Bringing War Criminals To Justice And Justice To Victims: Mass Rape In Bosnia-Herzegovina And The Efficiency Of The Icty, Meredith Loken

Independent Study Project (ISP) Collection

This paper investigates if the International Criminal Tribunal for the Former Yugoslavia has been efficient in achieving its main objective of “bringing war criminals to justice [and] bringing justice to victims.” This study explores the historical context by which the ICTY was created, and therefore examines the disintegration of Yugoslavia, focusing specifically on the Bosnian War. During this conflict, rape was employed as a method of warfare; this paper presents a brief theoretical examination of rape as a war weapon and analyzes rape and sexual violence as explicit methods of ethnic cleansing in Bosnia-Herzegovina. It explores the evolution of gender ...

Immature Citizens And The State, Vivian E. Hamilton Oct 2010

Immature Citizens And The State, Vivian E. Hamilton

Faculty Publications

Citizens are born, but they are also made. How its citizens come to be—whether the educations they receive will expand or constrain their future options, whether the values they assimilate will encourage or dissuade their civic engagement, etc.—fundamentally concerns the state. Through the power it wields over a vast range of policymaking contexts, the state can significantly influence (or designate those who will influence) many of the formative experiences of young citizens. Young citizens’ accumulated experiences in turn can significantly influence the future mature citizens they will become. The state insufficiently considers the cumulative nature of its citizens ...
