Moonshine To Motorfuel: Tax Incentives For Fuel Ethanol, Roberta F. Mann, Mona L. Hymel

Abstract: Biofuels have been embraced by supporters from President George W. Bush to the Natural Resources Defense Council. Before 1930, the U.S. Treasury focused on shutting down small alcohol producers. After 1978, U.S. energy policy sought to encourage ethanol production to reduce dependence on foreign oil. Federal and state incentives have been credited with increasing ethanol production from 175 million gallons in 1980 to 3.9 billion gallons in 2005. The Internal Revenue Code contains three income tax credits designed to encourage ethanol use: the alcohol mixture credit, the pure alcohol credit, and the small ethanol producer’s credit. Why The No Child Left Behind Act Needs To Be Restructured To Accomplish Its Goals And How To Do It, Gershon M. Ratner

The No Child Left Behind Act ("NCLB" or the "Act") 1 has created a once in a lifetime opportunity to improve American public education. NCLB has embraced vital goals for the new Information Age: academic proficiency for virtually all public school students and elimination of the severe racial/income "achievement gap." The Act provides four pillars on which states and localities might build a bridge to reach the goals: higher standards; periodic testing to measure the extent to which the standards are being met; disaggregating test results by student subgroup; and reporting to the public. The Individuals with Disabilities Education Act (IDEA)1 provides each child with a disability the opportunity to receive educational benefit in an appropriate program. The individual needs of the child drive the often resource intensive programs. On the other hand, public charter schools focus on providing more choices for education by aiming to do a better job with less money. Two Tailors: The Pursuit Of Racial Justice In 1970s Chicago, Susan L. Waysdorf

Every legal case has a story behind it, and some, like this one, also have a legacy. This is a story about two immigrant tailors in Chicago-the white tailor's attempt to sell his tailor shop to the black tailor, and the racial discrimination they confronted together. One tailor, Ivan Thompson, was a black citizen of Great Britain living in Chicago, and the other, Martin Waysdorf, was a white Jew from Poland. He became a. Should law be technologically neutral, or should it evolve as human relationships with technology become more advanced?

Susan Brenner analyzes the complex and evolving interactions between law and technology and provides a thorough and detailed account of the law in technology at the beginning of the 21st century. Brenner draws upon recent technological advances, evaluating how developing technologies may alter how humans interact with each other and with their environment. Recent events related to the planning and execution of the war in Iraq, most notably the perceived 2003 "firing" of then Army Chief of Staff Eric Shinseki, have raised concerns over the effect of Executive Branch dominance of the military and how that dominance impacts the ability of Congress to obtain timely and important information. Such actions, perceived to discourage members of the military from providing candid views to Congress when they differ with the Administration, even if implied instead of express, strike at the very core of the founder's intent to balance military power within the national government. The intermixing of combatants with civilians while engaging in hostilities violates one of the most fundamental principles of the law of armed conflict: the principle of distinction. This bedrock principle of the law of war requires those involved in conflict to mark themselves so they can be distinguished from those who are not involved in combat. The most common method of compliance is for combatants to wear a uniform. By requiring distinction, both combatants and civilians know who is involved in the combat and who is not. Az emberi lét földi kiterjeszthetõségének vannak ugyan bizonyos formai feltételei, de ezek nem azonosak az emberi lét feltételeivel. Így az ember szellemi fejlõdése az elemi tudati folyamatokban végbemenõ szimmetriasértéssel több dimenzióssá válhat. A nem földi alapú tudati mûködésünk így felveti a következõ kérdéseket. Hogyan és miért került a tudat (a szellem) a Földre? Honnan származik értelmünk? Azonban, a „Honnan jöttünk? - Kik vagyunk? - Hova megyünk? probléma tudományos, felelõs és igényes megoldás-keresõinek tisztában kell lenniük azzal, hogy még csak tudásunknak a gyermekkorában vagyunk, és így a múltról való tudás (a történelem) is gyorsan fog változni.

Manipulated Doctrines, Improper Distinctions, And The Law Of Racial Vote Dilution, Avram D. Frey

This paper is about the law of racial vote dilution. Racial vote dilution is both a constitutional and statutory harm, however, because race doctrine requires specific intent, the statutory arm under the Voting Rights Act is dominant in this field. In my paper, I attempt to decipher an underlying theory to unite the doctrine in this context. I then critique the theory which I conclude best fits the doctrine on normative grounds.
