The Status Of Taiwan Under International Law And In A Changing World, Eric Ting-Lun Huang Dec 2002

The Status Of Taiwan Under International Law And In A Changing World, Eric Ting-Lun Huang

Theses and Dissertations

The issue of Taiwan's status has long been disputed. Since 1949, more than half a century ago, a civil war divided a Chinese nation into two governments within the Chinese territories. One is the People's Republic of China on the mainland(China), the other is the Republic of China on Taiwan(Taiwan). Since then, China has long embraced the position of annexing Taiwan as its essential goal based on the political fiction of the one-China principle, assuming that "there is only one China internationally, Taiwan is a part of China, and the People's Republic of China is thesole government to represent the …

Multiple sources for data collection were deployed to explore and examine whether former agents perceive they were bullied at work and what mechanisms those employees found were helpful as coping strategies.

This research project used a non-random, purposeful sample selected from contacts established through the Federal Law Enforcement Officers Association. …

International Law And Business Practice : Corporate Accountability And Compliance Issues In The Petroleum Industry, Emeka Duruigbo

Theses and Dissertations

This dissertation seeks to strengthen international law by incorporating and integrating multinational corporations more fully into the international legal system. It argues that the undeniable role of multinational corporations as primary players in the global economy and international politics necessitates or demands adequate acknowledgement in the international legal structure. Accordingly, due recognition should be accorded the rights and privileges of multinationals. Concomitant to that, corresponding duties and responsibilities should be attached to these corporate entities in international law.

Many far-reaching advantages will flow from such development. The corporations will enjoy de jure protection, which would enhance their business operations across …

Measuring Morale In A Municipal Law Enforcement Agency: A Multidimensional Approach, Thomas J. Roth May 2002

Measuring Morale In A Municipal Law Enforcement Agency: A Multidimensional Approach, Thomas J. Roth

Muskie School Capstones and Dissertations

Administrators of both public and private sector firms are charged with the effective management of their respective agencies. Effective management includes not only striving to fulfil the goals of the organization toward the external client, it includes proper management of employees, a vital resource to any organization. Likewise, police administrators are bound by duty to not only uphold the laws within their jurisdiction, they are also responsible for maintaining a desirable work environment for their employees. Because a police agency's effectiveness is largely based on the combined total of the knowledge, skill and abilities of all its individual officers, employee …

East European Security Revisited: Institutions, Power, And Security, Blagovest Tashev Apr 2002

East European Security Revisited: Institutions, Power, And Security, Blagovest Tashev

Graduate Program in International Studies Theses & Dissertations

Drawing on the literatures on democratization, security studies, and small states this dissertation explores the relationship of small states' domestic and international institutionalization and their security. Small states have limited power not only to affect their environment but also to guarantee national security. Small states, it is hypothesized, enhance their security through the consolidation of domestic institutions and the accumulation of capacities provided by their participation in capacity-reach international institutions.

The dissertation tests the hypothesis by applying the comparative method to the post-communist states of Bulgaria, the Czech Republic, and Lithuania. The three case studies analyze the effects of domestic …

The International Criminal Court: A Contextual Study Of A Nascent Court Within The International Criminal Legal System, Ronald Ian Mackay Rennie

LLM Theses

The 'Rome Statute' of the International Criminal Court (ICC) represents an exciting and revolutionary development in the field of international law generally and international criminal law specifically. Unfortunately there are many ways in which academics, the media and political decision-makers misinterpret its intent and its nature. This thesis considers these traps and embarks upon an analysis of international criminal law by considering the content of the Statute and how it proceeds to establish an International Criminal Court, capable of bringing those most serious perpetrators to account. The subject matter of the ICC reveals a Court with a very limited jurisdiction, …

Deception In Advertising: A Content Analysis Of The Legal Parameters Of Deception, E. Carla Mitchell Jan 2002

Deception In Advertising: A Content Analysis Of The Legal Parameters Of Deception, E. Carla Mitchell

Theses and Dissertations in Business Administration

One of the primary attributes of a free market economy is the uninhibited flow of truthful information regarding the goods and services available in the marketplace (Azcuenaga 1995). This free flow of information, in the form of advertising, enhances market performance by informing consumers and enabling firms to compete equitably based on the attributes of their offerings. Studies reveal that, for the vast majority of marketing managers, the regulatory environment serves as the primary influence in advertising strategy development and decision-making (Davis 1994). However, in their theory development, behavioral researchers often ignore the legal aspects promulgated by the FTC. Furthermore, …

A 21st Century Perspective On Peru And The 1982 United Nations Convention On The Law Of The Sea, Pedro Nolasco Terry Guillen

World Maritime University Dissertations

The adoption of the United Nations Convention on the Law of the Sea in 1982, constituted the major political and legal achievement that the International community has ever achieved, regarding the uses of the sea. It is considered as the Constitution of the Oceans binding upon all States, whether they are party or not to the Convention, as part of the current customary international law. Countries holding unilateral positions in this regard are every day less accepted and supported by the international community as a whole.

The fundamentals of the 200nm thesis are now part of the main legal regimes …

Clinton's Foreign Policy And The Politics Of Intervention: Cases Of Ethnic Cleansing And Democratic Governance, Daneta G. Billau

Graduate Program in International Studies Theses & Dissertations

This dissertation examines the sources of U.S. President Bill Clinton's foreign policy, with special attention to understudied political elements of intervention. The basis of this study is the Clinton Doctrine, in which Clinton opposed ethnic cleansing, and supported democratic governance worldwide. The primary research question asks to what extent and why was there a variation in Clinton's application of his own doctrine in the specific cases of Rwanda in 1994, Haiti in 1994, and East Timor in 1999. To address this question, the following five hypotheses are posited:

H1: The more vital interests are at stake, and the closer the …

Women's Experiences Of The Workers' Compensation System In Queensland, Australia, Jo Calvey

Theses: Doctorates and Masters

This was a phenomenological study undertaken to understand women's experience of the workers' compensation system. Eleven women were interviewed. They ranged in age from twenty-five to sixty-five years and represented diverse socio-economic and educational backgrounds. All women were from a non-indigenous background. The initial question to women was "Can you tell me what it is like to be involved in the workers' compensation system?" The narratives were analysed and interpreted using Hycner's (1985) phenomenological guidelines. Five core themes were found: negative versus positive/neutral experiences, the workplaces response and role in the process, women's experiences of payouts and tribunals, reasons why …

Title Ix: The End Of Gender Discrimination?, Micah Smith Jan 2002

Title Ix: The End Of Gender Discrimination?, Micah Smith

Honors Theses

Title IX has, in this day, become a topic that is both controversial and confusing. Nearly anyone in the United States today that is moderately well informed is able to relate something about Title IX and its effects. In response to an inquiry of the nature of Title IX, some would answer that Title lX is the law that requires colleges to have an equal number of athletics teams for men and women. Another person might answer that Title IX is a law that has promoted women's sports to new heights, culminating in the American victory at the Women's World …
