The essay deals with the features of, and the challenges posed by the initiatives aiming to harmonize European private laws. The first part focuses on the comparison of (overt) methods and (hidden) implications pursued by research-oriented enterprises – such as ‘The Common Core Project’ or the ‘European Case-books Project’ –, and the initiatives whose goal is the creation of rules – such as the UNIDROIT Principles or the ‘Lando Commission’ –. The paper analyzes and compares the liability rules which apply to public authorities’ wrongful acts under French, German, Italian, and Anglo-American law. More in particular, the paper examines the acts that, in the concerned jurisdictions, may trigger the liability of public authorities, the tort law remedies that may be sought against them, and the courts that are competent to hear such claims.

According to many observers, one of the critical factors accounting for the unprecedented economic growth that the United States enjoyed during the past decade is a regulatory regime that places few restrictions on an employer's ability to shed unwanted employees. Similarly, the slower economic growth that Germany and Europe experienced during this period often is attributed to elaborate employment protection schemes that restrict the ability of employers to discharge undesired workers. These protections are blamed for making countries like Germany less attractive places for foreign investment. This article is the third of four major articles or book chapters that I have written about MDPs. This article focuses on German multidisciplinary partnerships (MDPs) between lawyers and accountants. The German MDP experience is important because Germany is one of the few jurisdictions that expressly permits MDPs and because conferences about World Trade Organization's General Agreement on Trade in Services (the GATS) have cited to Germany when suggesting that other countries' MDP bans may be unnecessarily restrictive.
