On Protecting Accountability, Eric M. Freedman

Hofstra Law Review

Today's subject, whether a sitting President may be indicted, is one that I have addressed in print over many years, dating back to the Nixon Administration. In particular, I am the author of The Law as King and the King as Law: Is a President Immune from Criminal Prosecution Before Impeachment?' which I believe remains the most complete and thoroughly-documented scholarly study of the issue. Since it contains a good deal of additional legal and historical data backing up the principal points I will be making, I hope you will read it in full (or at least refer to its …

The United States Supreme Court Resolves The Effect Of Disability Benefit Claims Upon Americans With Disabilities Act Complaints In Cleveland V. Policy Management Systems Corporation, Christine Neylon O'Brien

Hofstra Labor & Employment Law Journal

Federal courts have grappled with the issue of whether claims under the Americans with Disabilities Act should be barred, or judicially estopped, by the plaintiff's earlier application for or receipt of disability benefits. We begin with this question: what is a war crime and how have the definitional difficulties come to the fore in conjunction with the International Criminal Tribunal for the Former Yugoslavia? One broad category of war crimes, called "crimes against peace," as established by the Nuremberg Charter,' is simply commencing an aggressive war in violation of treaties. A second category is "crimes against humanity." But in the definition of a crime against humanity there is a qualifying phase - …
