Lawyering And Client Decisionmaking: Informed Consent And The Legal Profession, Mark Spiegel

In this Article, Professor Spiegel examines the doctrine of informed consent as it relates to the legal profession. The Article first traces the development of the informed-consent doctrine and then considers the extent to which current legal doctrines and professional norms incorporate informed consent between lawyers and their clients. Professor Spiegel suggests that the predominant focus of informed consent is on a lawyer’s power to bind his client vis-à-vis third parties and advocates for the development of an informed-consent doctrine that accounts for the interests of all parties involved. In this Article, Professor Baron challenges the position taken recently by Dr. Arnold Relman in this journal that the 1977 Saikewicz decision of the Supreme Judicial Court of Massachusetts was incorrect in calling for routine judicial resolution of decisions whether to provide life-prolonging treatment to terminally ill incompetent patients. First, Professor Baron argues that Dr. Relman's position that doctors should make such decisions is based upon an outmoded, paternalistic view of the doctor-patient relationship. Negotiating In Anticipation Of Arbitration: Some Guidelines For The Initiated, Roger Abrams

Participants in the collective bargaining process view the successful negotiation of an agreement as the welcome end to what may have been an unpleasant ordeal. More often than not, however, in order to reach agreement, the participants have based their agreement on vague promises offered in the heat of negotiations. Thus, the collective agreement may be only the beginning of more problems once later disputes reveal its inadequacies. Professor Abrams observes that collective bargaining is not a finite but a continuing process. Dam Safety: The Critical Imperative, Denis Binder

The spectacular nature of the Teton Dam break emphasizes the basic problem of Dam Safety in this country. Nevertheless, it took several dam breaks and near-misses before the Federal Dam Safety Inspection Act was passed in 1972. It took another series of dam breaks and close-calls for meaningful implementation of the Act to result. Accordingly, this article sets forth a number of critical measures which are essential to a viable dam safety program. Using this model, the author evaluates the Federal Dam Inspection Act, the proposed model codes, and the existing state regulatory procedures and makes appropriate recommendations.
