To prepare a draft of proposed rules, the Chief Justice of the United States, as chairman of the Judicial Conference, appointed an Advisory Committee of fifteen members. Membership is comrpised of eight trial attorneys, the former chief of the criminal appeals unit of the Department of Justice, four federal judges, and two members of law school faculties. A third academician, Edward W. Cleary, who before teaching had 11 years of active practice, is Reporter for the Committee, furnishing many of the ideas, doing or directing most of the research, and usually doing the original drafting. The grievor contested with another employee which of them was to do certain work, which led to the grievor's assaulting the other employee. The company discharged the grievor, thus bringing about the present arbitration, the sole issue being whether, in view of the grievor's record, his participation in the fight constituted just cause for his dismissal. There was no direct evidence that the grievor had in fact started the fight and his discharge seems to have resulted from an alleged agreement between the union and company to dis­charge the employee who seemed to have started the fight.
