Introduction. Journalistic and scholarly accounts of the breakup of Yugoslavia contain, taken together, a curious contradiction. On the one hand, it is said, Yugoslavia was never anything more than a "bad dream,"' a flawed attempt to unify "from above" peoples who have historically hated one another. The immediate causes of the conflict are therefore simply centuries-old ethnic hatreds. The veneer of Yugoslav federal unity was nothing more than a myth, a cosmetic surface stripped away in a trifling by deeper and darker enmities. On September 16, 1993, United States President Bill Clinton and his counterparts in Mexico and Canada signed the environmental supplement to the North American Free Trade Agreement (NAFTA). This environmental agreement addresses two main issues: enforcement of domestic environmental laws through possible trade sanctions and environmental cooperation among the three Parties-both to be implemented by a newly created Commission on Environmental Cooperation (CEC). Although increased environmental cooperation possesses no legal mandate per se and has been characterized by some as "green window-dressing," the CEC's authority to examine virtually any environmental issue related to trade is precedent setting. Sovereignty is the fundamental concept around which international law is presently organized. This principle holds that "[e]xcept as limited by international law or treaty, each state is master of its own territory." Consistent with this conception of absolute sovereignty, international law has traditionally been concerned with the relations between co-equal sovereign states. Each sovereign state can only be legally bound by those commitments it willingly makes to other sovereign states, and by those few principles which are viewed as binding on all states. Enforcement Of Environmental Laws Under A Supplemental Agreement To The North American Free Trade Agreement, William Snape

INTRODUCTION: Enforcement of environmental laws is one of the key issues in the debate over the relationship between trade and environment in the North American Free Trade Agreement (NAFTA). Without uniformly strong enforcement in all three NAFTA nations, there is the potential for in- creased migration of "dirty" industries to nations with lax enforcement, and for increased environmental degradation. Furthermore, industries subject to lax enforcement do not have to internalize environmental compliance costs and so have a competitive advantage over their international rivals. Following the United States' acquisition of California under the 1848 Treaty of Guadalupe-Hidalgo, Congress passed "An Act to ascertain and settle the private Land Claims in the State of California." This statute established a commission to determine the status of the approximately 750 land grants that Spanish and Mexican authorities had made to private individuals before 1848. Congress provided that the commission and courts should evaluate the validity of the grants by, among other criteria, "the laws, usages, and customs of the government from which the claim is derived, the principles of equity, and the decisions of the Supreme Court …
