Education Match And Job Match, Joni Hersch Dec 1990

Education Match And Job Match, Joni Hersch

Vanderbilt Law School Faculty Publications

Using a new data set, this paper gives evidence in support of the intuitive notion that overqualified workers are less satisfied with their jobs and are more likely to quit. However, training time is inversely related to overqualification, which suggests why such seeming mismatches occur and may in fact be optimal.

Old Friends - New Realities: California's Economic Relationship With Hong Kong And Taiwan And Trade Policy Report, California Commission For Economic Development, Advisory Council On Asia

California Agencies

Last year the Advisory Council on Asia (ACA) was asked by Lieutenant Governor Leo McCarthy to conduct a fact-finding mission to Asia. We believed, as he did, that the pace of economic and political developments in the region was reshaping Asia so quickly and so profoundly that the attention was warranted. As members of California's Asian community and business people involved with Pacific Rim commerce, we believed we could make a major contribution in assessing these developments and their importance to California.

We had not anticipated, however, that our mission would provide the impetus for a series of reports ...

The Interplay Of Civil Service And Collective Bargaining Law In Public Sector Employee Discipline Cases, Ann C. Hodges Dec 1990

The Interplay Of Civil Service And Collective Bargaining Law In Public Sector Employee Discipline Cases, Ann C. Hodges

Law Faculty Publications

This article undertakes such a review with respect to one aspect of the potential conflict between merit systems and collective bargaining- employee discipline and the appeal of discipline decisions. Protection from arbitrary or unjust discipline is a primary motivation for employee unionization. As a result, achieving protection from unjust disciplinary action becomes a fundamental goal of unions in collective bargaining. Public sector unions in the United States are particularly interested in "discipline, grievance procedures and organizational due process"....

Section IV of this article reviews the approaches of the various states that have addressed the issue, analyzing them in light of ...

Employer Sanctions And The Question Of Discrimination: The Gao Study In Perspective, Vernon M. Briggs Jr. Dec 1990

Employer Sanctions And The Question Of Discrimination: The Gao Study In Perspective, Vernon M. Briggs Jr.

Articles and Chapters

"The enactment of the Immigration Reform and Control Act of 1986 (IRCA) produced the most extensive legislation in the area of employment law in the United States in two decades (i.e., since the adoption of the Occupational Health and Safety Act of 1970). Its provisions affect every employer and every job seeker since the law went into effect on November 6, 1986. Among its multiple provisions were strictures designed to prohibit employers from hiring illegal immigrants. This action had the effect of repealing the 'Texas Proviso' of the Immigration and Nationality Act of 1952 that specifically exempted the employment ...

Rethinking Minority Business Development Strategies, Robert E. Suggs Dec 1990

Rethinking Minority Business Development Strategies, Robert E. Suggs

Faculty Scholarship

Minority business set-asides were created as a prophylactic measure to redress discrimination against minority owned business firms. Predominantly minority jurisdictions found them especially attractive because they promised to provide minority firms a share of the procurement dollars expended by these jurisdictions. The Croson decision invalidated Richmond’s ordinance and posed substantial barriers to further enactments. This article proposes an alternative to such set-aides. It argues that the proposed alternative, an Equal Opportunity Rating Agency (EORA), provides a superior business development policy tool and does not have the constitutional vulnerabilities of set-asides. An EORA would operate much like a credit rating ...

A Survey Of The Utilization Of The U.S. Consumer Product Safety Commission's Guidelines For Playgrounds In Tennessee, Michael Alsup Dec 1990

A Survey Of The Utilization Of The U.S. Consumer Product Safety Commission's Guidelines For Playgrounds In Tennessee, Michael Alsup

Masters Theses & Specialist Projects

The U.S. Consumer Product Safety Commission's A Handbook For Public Playground Safety was published in 1981 in response to a petition to develop a mandatory set of safety standards. The National Recreation and Park Association and the National Bureau of Standards were selected to work on the project. As the study developed, the Commission realized that a set of standards was needed instead of mandatory requirements.

Because there has not been any improvement in injury statistics nation-wide to date, the purpose of this study was to determine the degree of utilization of the guidelines in Tennessee. This was ...

Negotiability, Property, And Identity, James S. Rogers Dec 1990

Negotiability, Property, And Identity, James S. Rogers

Boston College Law School Faculty Papers

In this Article, Professor Rogers challenges the assumption that securities transfer law has always been based on negotiable certificates and suggests that the reign of negotiability is a relatively recent, and brief, phase in the long history of investment securities trading. Professor Rogers posits that the difficulties currently facing the law of securities transfers are in large part due to the transition from paper to electronic representations of investments. To place these challenges into perspective, Professor Rogers first surveys the history of securities trading and then examines the theoretical underpinnings of the law of securities transfers.
