The object of this study is, as suggested by its title: "The Role of the International Law Commission in the Decade of International Law". In this exercise, the title role will be played by the International Law Commission in the context of the 'Decade of International Law' recently proclaimed by the General Assembly of the United Nations. The contribution to be expected of the Commission will be viewed from the perspective of the prospect of enhancing the practice of states in the adoption of available means of their choice for the peaceful settlement of international disputes.

Old Friends - New Realities: California's Economic Relationship With Hong Kong And Taiwan And Trade Policy Report, California Commission For Economic Development, Advisory Council On Asia

Last year the Advisory Council on Asia (ACA) was asked by Lieutenant Governor Leo McCarthy to conduct a fact-finding mission to Asia. We believed, as he did, that the pace of economic and political developments in the region was reshaping Asia so quickly and so profoundly that the attention was warranted. As members of California's Asian community and business people involved with Pacific Rim commerce, we believed we could make a major contribution in assessing these developments and their importance to California.

A Survey Of The Utilization Of The U.S. Consumer Product Safety Commission's Guidelines For Playgrounds In Tennessee, Michael Alsup

The U.S. Consumer Product Safety Commission's A Handbook For Public Playground Safety was published in 1981 in response to a petition to develop a mandatory set of safety standards. The National Recreation and Park Association and the National Bureau of Standards were selected to work on the project. As the study developed, the Commission realized that a set of standards was needed instead of mandatory requirements.
Because there has not been any improvement in injury statistics nation-wide to date, the purpose of this study was to determine the degree of utilization of the guidelines in Tennessee. This was seen as …

The Interplay Of Civil Service And Collective Bargaining Law In Public Sector Employee Discipline Cases, Ann C. Hodges

This article undertakes such a review with respect to one aspect of the potential conflict between merit systems and collective bargaining- employee discipline and the appeal of discipline decisions. Protection from arbitrary or unjust discipline is a primary motivation for employee unionization. As a result, achieving protection from unjust disciplinary action becomes a fundamental goal of unions in collective bargaining. Public sector unions in the United States are particularly interested in "discipline, grievance procedures and organizational due process"....

Rethinking Minority Business Development Strategies, Robert E. Suggs

Minority business set-asides were created as a prophylactic measure to redress discrimination against minority owned business firms. Predominantly minority jurisdictions found them especially attractive because they promised to provide minority firms a share of the procurement dollars expended by these jurisdictions. The Croson decision invalidated Richmond’s ordinance and posed substantial barriers to further enactments. This article proposes an alternative to such set-aides. It argues that the proposed alternative, an Equal Opportunity Rating Agency (EORA), provides a superior business development policy tool and does not have the constitutional vulnerabilities of set-asides. An EORA would operate much like a credit rating agency, …
