After protracted deliberations, the Environmental Protection Agency decided to dredge large quantities of sediment from the upper reach of the Hudson River in order to remove a small portion of the PCB's that came from two General Electric factories. They used these chemicals from the 1940s through the mid-1970s. The corporation will be required to pay for the clean up. The agency's administrators appointed by both Presidents Clinton and Bush as well as leading newspapers explained the decision to the public as required to protect the broad public from a significant risk to human health. Preserving Monumental Landscapes Under The Antiquities Act, Christine A. Klein

This Article examines the Antiquities Act, a 1906 statute that delegates authority to the President to establish national monuments on federal lands for the protection of prehistoric structures and relics. This modest statute, originally a scant one page in length, has set off a century of intermittent controversy that its drafters could not have anticipated. Although Congress probably intended that the statute merely protect archaeological ruins from looting by treasure hunters, presidents quickly began to utilize the statute to preserve large natural landscapes -- ranging from President Theodore Roosevelt's establishment of the 800,000-acre Grand Canyon National Monument in 1908 to …

Treaties In Collision: The Biosafety Protocol And The World Trade Organization Agreements, Sabrina Safrin

In the event of a conflict between the requirements of the Biosafety Protocol, a multilateral agreement governing the trade in genetically modified organisms, and the requirements of the General Agreement on Tariffs and Trade and associated agreements (collectively WTO Agreements), which treaty's requirements prevail? This question lies as the legal heart of the perceived conflict between trade globalization and environmental protection. This issue is particularly timely given the present trade dispute between the United States and European Union over the European Union’s restrictions on the importation of genetically modified agricultural commodities.
