Selected Criminal-Law Cases In The United States Supreme Court In The 2009-2010 Term, And A Look Ahead, Charles D. Weisselberg May 2015

Selected Criminal-Law Cases In The United States Supreme Court In The 2009-2010 Term, And A Look Ahead, Charles D. Weisselberg

Charles D Weisselberg

Issues that are hot one Term are sometimes cold the next. In contrast with the 2008 Term - when the Court took on automobile searches, the scope of the Fourth Amendment exclusionary rule, and the Confrontation Clause - the big cases of 2009-2010 addressed different issues. This past year will be remembered for decisions on the right to counsel for immigrant defendants, the Eighth Amendment and juveniles, the application to the states of the Second Amendment right to keep and bear arms, and key decisions on jury-trial rights. While the 2008 Term gave us Montejo v. Louisiana - an important holding on the ...

Dna, Dogs, The Nickel, And Other Curiosities: Criminal Law Cases In The Supreme Court's 2012-2013 Term, Charles D. Weisselberg

Charles D Weisselberg

For readers who would like to review the truly momentous cases of the Supreme Court's last Term, I heartily recommend Professor Todd E. Pettys's article, More than Marriage: Civil Cases in the Supreme Courts 2012-2013 Term, which also appears in this issue of Court Review. During this past Term, like the one before it, the real blockbusters were on the civil side. But the Court's criminal docket was not without its charms. The justices wrestled with the collection of DNA evidence from arrestees, canine sniffs at the front door, non-custodial suspects' silence in the face of questioning ...

Cell Phones And Everything Else: Criminal Law Cases In The Supreme Court's 2013-2014 Term, Charles D. Weisselberg

Charles D Weisselberg

As in the past few years, most of the action in the Supreme Court's 2013-2014 Term was on the civil side of the docket. On the criminal side, the undisputed blockbuster was Riley v. California, a seminal ruling about searches of cell phones incident to arrest. Riley is significant for several reasons, not the least of which is that it displays the justices' understanding of new technologies (at last!) and their recognition that cases involving today's technologies are difficult to decide by simple reference to the brick-and-mortar world. This article starts with Riley and other Fourth Amendment decisions ...

Building Clinical Legal Education Programs In A Country Without A Tradition Of Graduate Professional Legal Education: Japan Educational Reform As A Case Study, Peter A. Joy, Shigeo Miyagawa, Takao Suami, Charles D. Weisselberg

Charles D Weisselberg

Japan is transforming its justice system and the way in which it educates lawyers. As a major part of its reforms, Japan recently established graduate professional law schools, largely based upon the model of legal education in the United States. This article examines the roles of the new professional law schools — focusing on clinical legal education — within the broader context of the overall reforms of the Japanese justice system. Japan's efforts are very significant inside and outside of the country, and other nations are watching with interest. This article treats Japan's experience ...

Big Law's Sixth Amendment: The Rise Of Corporate White-Collar Practices In Large U.S. Law Firms, Charles D. Weisselberg, Su Li

Charles D Weisselberg

Over the last three decades, corporate white-collar criminal defense and investigations practices have become established within the nation's largest law firms. It was not always this way. White-collar work was not considered a legal specialty. And, historically, lawyers in the leading civil firms avoided criminal matters. But several developments occurred at once: firms grew dramatically, the norms within the firms changed, and new federal crimes and prosecution policies created enormous business opportunities for the large firms. Using a unique data set, this Article profiles the Big Law partners now in the white-collar practice area, most of whom are male ...
