The bill as passed by the Senate would create a registry of electronic contact points for children and prevent anyone wishing to send messages advertising content that is illegal for a minor to purchase, view, possess, participate in or receive from sending to a registered contact point. The system would be funded by charging senders a fee for scrubbing their address lists. The bill provides for both criminal and civil penalties. The bill was modified in the House committee to replace the registry with a requirement that messages advertising such things as pornography, gambling and prostitution must contain ADV:ADLT in …

The bill would have required certain divorcing parents with dependent children under 18 years of age to participate in education classes and provided the different types of professionals who could conduct the classes. The bill also would have enacted a waiting period changing the time a court could grant a divorce to 120 days from the date of the parties' separation when the parties have children 18 years of age or younger. The Act criminalizes transporting a person for the purpose of prostitution. It raises the punishment for sexual battery against a child under the age of 16 from a misdemeanor to a felony. It adds language criminalizing the depiction of a minor's body part engaged in any sexually explicit conduct. Finally, the Act substantially amends the Code language relating to computer pornography, obscene Internet contact with a child, and child exploitation prevention.

The Act provides that prosecution for serious violent offenses may be commenced at any time under certain circumstances. The Act removes the statute of limitation for the prosecution of Armed Robbery, Kidnapping, Rape, Aggravated Child Molestation, Aggravated Sodomy, and Aggravated Sexual Battery when DNA evidence is available to determine the identity of the accused and a sufficient portion of such DNA evidence is available for the accused to test. The Act also provides that the age limitation on prosecutions of certain crimes involving children who are victims be increased to age eighteen.

Domestic Relations Alimony And Child Support Generally: Provide For Accident And Sickness Insurance Coverage For Children, Charles F. Fenton

The Act provides for a mechanism for the Department of Human Resources, the Department of Medical Assistance, or a custodial parent to require a support-paying parent's employer to obtain court-ordered accident and sickness insurance on behalf of the parent's child. The Act provides for criminal and civil penalties for any employer who does not abide by an enrollment order.

The Act clarifies what sources of support the court may consider available to an applicant for year's support, as well as clarifying who has the burden of proof in showing the amount of support necessary. The Act also removes the former requirement that all debts of the estate be paid before an applicant can receive year's support for subsequent years.

The Act amends the Georgia pandering statute, O.C.G.A. 16-6-12, to define the offense in gender-neutral language. The Act also amends O.C.G.A. 16-6-13 and 16-6-15 to punish the offenses of prostitution, keeping a house of prostitution, pimping, pandering, and soliciting sodomy as felonies when persons under the age of seventeen are involved.
