This Note presents an original proposal for extending copyright protection to food (not to the appearance of the food, nor to the recipe for the food, but to the food itself). Because of the unusual nature of the suggestion, the Note begins with a detailed statement of the proposal: the intended beneficiaries, the dearth of current protection, and the recommended judicial action. It then covers the proposal's relationship to the Constitution and the legislative history of the 1976 Copyright Act. Finally, the Note briefly discuss the proposal's administrability. The contemporary American concept of stewardship has been criticized for failing to meet the needs of modern society. Critics say that the concept of stewardship is missing or dead in America. This paper proposes that before we speculate on the demise of stewardship in the not too distant future we consider its historical evolution. This paper uses a cross-national approach to trace the concept of stewardship within its socihistorical context from 13th century England to the modern American corporation. By identifying how stewardship has evolved differently in America than it did in England, the authors conclude that stewardship is alive …

It is shown that there is only equilibrium solution of cosmology problem of the general relativity theory in case of the homogeneous-isotropic perfect fluid and the real energy density, pressure and the cosmological constant is not equal to 0. Furthermore, the equilibrium solution -inclusive the Einsten's one- is stable even if the pressure and density are positive semidefinite.

Engaging The Spectrum: Civic Virtue And The Protection Of Student Voice In School-Sponsored Forums, Robert R.M. Verchick

This article suggests a new justification for protecting student speech that specifically addresses the need for free expression and inquiry in school- sponsored forums. Starting with the proposition that student speech prepares one for self-government, I suggest we re-define the kind of self-government to which we ask students to aspire. By recasting our conception of democracy in a way that highlights universal participation and group transformation, we will find a theory of government much closer to the values of group discovery and social reform.

Toward A Distinctive Canadian Corporate Law Regime, Ronald J. Daniels, Jeffrey G. Macintosh

In this article, the authors consider the impact of the institutional and market environment in which Canadian business operates on the structure of corporate and securities law. The authors argue that the linkages between markets and law have been neglected by scholars, judges, and regulators concerned with Canadian corporate and securities law, resulting in the adaption of approaches that are ill-suited to the Canadian environment. Canadian capital markets, for instance, are characterized by high levels of share ownership concentration, thin trading problems, intensive inter-corporate linkages, and possibly lower levels of efficiency. The Parol Evidence Rule In Wisconsin: Status In The Law Of Contract, Revisited, Michael Anthony Lawrence

This Comment surveys Wisconsin parol evidence cases decided from 1980 through mid-1991. Drawing upon a 1972 New York University Law Review article for its methodology, the Comment empirically examines whether it is useful to categorize Wisconsin decisions according to the business sophistication (i.e., “status”) of parties to the contract. The Comment concludes that status is important in Wisconsin parol evidence cases, despite the fact that courts rarely mention it as a factor. The data indicate that the nature of the proffered parol evidence is important as well.
