The U.S. Supreme Court’s October 2007 Term had a substantial and notable criminal docket. There were very significant Second, Sixth, and Eighth Amendment decisions as well as important rulings relating to basic habeas corpus principles and federal statutes. This article provides a selected overview of the Term with a heavy emphasis on those cases that may have the greatest impact upon the states. The article also suggests some questions left open by the Court’s opinions and provides some preliminary indications of how several decisions are being received in state and federal courts. It concludes with a preview of some cases …

Issues that are hot one Term are sometimes cold the next. In contrast with the 2008 Term - when the Court took on automobile searches, the scope of the Fourth Amendment exclusionary rule, and the Confrontation Clause - the big cases of 2009-2010 addressed different issues. This past year will be remembered for decisions on the right to counsel for immigrant defendants, the Eighth Amendment and juveniles, the application to the states of the Second Amendment right to keep and bear arms, and key decisions on jury-trial rights. As in the past few years, most of the action in the Supreme Court's 2013-2014 Term was on the civil side of the docket. On the criminal side, the undisputed blockbuster was Riley v. California, a seminal ruling about searches of cell phones incident to arrest. Riley is significant for several reasons, not the least of which is that it displays the justices' understanding of new technologies (at last!) and their recognition that cases involving today's technologies are difficult to decide by simple reference to the brick-and-mortar world. Japan is transforming its justice system and the way in which it educates lawyers. As a major part of its reforms, Japan recently established graduate professional law schools, largely based upon the model of legal education in the United States. This article examines the roles of the new professional law schools — focusing on clinical legal education — within the broader context of the overall reforms of the Japanese justice system. Over the last three decades, corporate white-collar criminal defense and investigations practices have become established within the nation's largest law firms. It was not always this way. White-collar work was not considered a legal specialty. And, historically, lawyers in the leading civil firms avoided criminal matters. But several developments occurred at once: firms grew dramatically, the norms within the firms changed, and new federal crimes and prosecution policies created enormous business opportunities for the large firms.
