Sb320: A Call To Arms For Victims Of Domestic Violence, Golden Gate University School Of Law

Under California law, a person restrained by any domestic violence protection order is prohibited from owning, possessing, purchasing, receiving, or attempting to purchase or receive a firearm while the order is in effect. According to the Armed Prohibited Persons System (APPS), over 23,000 restricted people are armed in California. This number reflects only the number of known registered firearms in the state. Of these 23,000 restricted people, special agents recovered 1,243 prohibited firearms last year — 778 of those firearms were identified in APPS; however, 465 were previously unknown.

Since the Louisville, Kentucky police killed Breonna Taylor in the middle of the night in her own apartment, the United States has seen an uptick in protests against racially motivated police violence. However, the officers responsible for her death have not been criminally charged, in part because her boyfriend, unaware that police were entering the apartment in the middle of the night, shot one of the officer’s in the leg, “justifying” the next six rounds that were shot by the police and ultimately killed an innocent woman during the botched police raid.

In 1997 Daniel Mendoza was shot by an off-duty Las Vegas Metro police offcer. The offcer who pulled the trigger had been drinking heavily and wanted to “harass dopers and bangers.” The offcer in question fired into a group of people from the passenger side of a vehicle. This offcer was tried and convicted, which sounds like a success.

However, when an offcer is not stopped before killing a citizen without regard to whether there was a suspected crime, it highlights a problem of accountability.

Article II of the United States Constitution grants the President unlimited authority to pardon. Specifically, the President “shall have power to grant reprieves and pardons for offences against the United States (“U.S.”), except in cases of impeachment.” Once a pardon is issued, it must be accepted by the pardoned individual for the pardon to take effect. On August 25, 2017, President Donald J. Trump pardoned Sheriff Arpaio of a conviction for contempt of court. The criminal law of the United States fails to stop the unlawful killing of minorities by law enforcement. In fact, it was never meant to do so. Civil tort law is also unequal to the task. The consequences of not correcting these legal failures are far-reaching for the United States and for our neighbors, and have so far been underreported. This article explores the direct and indirect costs of these failings, positive measures already underway, and makes further sugges-tions for reform.

The California State Legislature requested a blueprint for implementing certain recommendations of the Little Hoover Commission (LHC), the Parks Forward Commission, and others for organizational change at the Department of Parks and Recreation (DPR). In its March 2013 report, “Beyond Crisis: Recapturing Excellence in California’s State Park System,” LHC recommended transforming DPR into a new operating model built around shared management, innovation, greater transparency, and the expectation that it generate more revenue from its operations.1 LHC recommended two specific actions as critical steps to achieving the transformation: first, to create a promotional path to management for staff without law enforcement …

This Comment proposes that California adopt legislation to regulate law-enforcement taser use. Part I introduces the history of tasers and their current use in law enforcement. Part II.A explains the need for legislation in California, supported by the documented deaths and health risks associated with taser use, and the widespread concern about police use among various private and governmental organizations. Part II.B identifies the successful taser legislation of other states, while Part II.C discusses an unsuccessful attempt at taser legislation in California.
