Recall, a court's “inquiry into the propriety of a state election law depends upon the extent to which a challenged regulation burdens First and Fourteenth Amendment rights." Burdick, 504 U.S. at 434. Plaintiffs contend that there is no doubt that the 12,500 signature requirement burdens the First and Fourteenth Amendments. The extent of the burden is tremendous for the reasons enunciated, in particular how the requirement tramples on the right of freedom of political of association. The 12,500 signature requirement severely burdens First and Fourteenth Amendment rights and are not narrowly drawn to advance Illinois's interest. Cf. Storer, 415 U.S. …

In order to be a solid Law Enforcement leader, one must possess excellent social skills. Included should be expertise in interpersonal conflict resolution. Yes, Pistole has an obligation to keep travelers safe; however, Pistole also has an obligation to guard children from being groped by TSA employees. Pistole has an obligation to allow men and women to be free from exploitation by TSA workers. Since we are country characterized by Democracy, Pistole has an obligation to do what the people ask when the request is reasonable. This obligation extends to all of our federal elected officials. The Transportation Security Administration (TSA) head, John Pistole, has become known by many Americans this week because of his hard-line, inflexible stance that aggressive patdowns of airport passengers will not be modified. On late evening of October 7, 2010, in the 5600 block of South Kilbourn Street, Chicago, 89 year-old Andri Jakymec (who suffers with Alzheimer's disease) and his 84 year-old wife were confronted by members if the Cook County Sheriffs Department who were looking for drugs. These officers entered the city of Chicago to raid the Jakymec home. They used a battering ram to knock down the front door of the home. Once they gained entry, an officer threw a grenade (it was either a flash grenade of percussion grenade). Witnesses say the officers were there for over 45 minutes. Within …

The U.S. Supreme Court in its decision overturning Chicago’s gun ban issued a stinging indictment of the Chicago Police Department (CPD) and the politicians who regulate it. General McChrystal’s insubordinate statements about the President and Vice President of the United States represent a violation of the Uniform Code of Military Justice (UCMJ). What the Obama administration should take from this unfortunate event is that the top commander in Afghanistan (and in any war for that matter) should be a United States Marine general. Marines stay fit. Marines follow orders. Marine officers set the example. We must be critical of General McChrystal for setting the most abhorrent of examples for the men and women of the U.S. Army.

On June 4, 2010, when Chicago Police Officer John Ardelean walked out of a Chicago courthouse a free man, in the face of evidence that he was drunk when he crashed his SUV and caused the deaths of two Mexican-American men, it became clear that more than 39 years Post Serpico police reform in the United States was undone in one morning court hearing. For obvious reasons, Ardelean’s case has garnered national attention because of the judge’s comments and ruling. Is it every parent’s nightmare that the police will throw a grenade through the living room window striking their 7 year-old and then fire a bullet into the child’s forehead? A Police department’s officers are trained to enable [U.S.] Constitutional due process safeguards, armies are not designed with this purpose-- armies are trained to kill. The suggestion of the National Guard to be deployed in black and Mexican neighborhoods in Chicago is an outgrowth of the scary trend toward militaristic policing by many police agencies in the U.S. (Chicago in particular). The problem is compounded by many men with militaristic aspirations, but lacking courage for military service; rather using police work and low-income residential communities as way to achieve military aspirations.

The decision by the New York Court of Appeals in Brady v. The Williams Capital Group, L.P., 2010 WL 1068163 (N.Y. Mar. 25, 2010) should cause us to note that some employer mandated arbitration agreements not only take away an employee’s right to sue the employer in court, but as well, impose arbitration costs\expenses on the employee. The employee who lacks funds is unable to make use of the arbitration process. An arbitration provision is not rendered inherently unconscionable because some of the arbitration costs will be imposed on the claimant. See Zobrist v. Verizon Wireless, 354 Ill. App. 3d …
