A Obrigação De Reparar Por Danos Resultantes Da Liberação Do Fornecimento E Da Comercialização De Medicamentos, Lucas Abreu Barroso, Pablo Malheiros Da Cunha Frota

Lucas Abreu Barroso

This study expresses a commentary on the paradigmatic Law 12,190/2010. In this law the State once again acknowledges its responsibility in relation to the Thalidomide Syndrome. Besides the social security pension of former times, this time it stipulates compensation for moral damage. However, from in a critical perspective, the obligation to pay damages would be more extensive than the exclusive satisfaction of the victims.

Consideraciones En Torno De La Indignidad Para Suceder.

Law Of Contempt, Ranganath Vg. Jul 2010

Law Of Contempt, Ranganath Vg.

Dr. V.G.Ranganath

In India until 1926, we don’t have any law on Contempt of Courts. Till then the precedents established by English Courts governed the cases pertaining to Contempt of Court. The first law relating to contempt of court was brought into force in the year 1926. It was known as “The Contempt of Court Act, 1926”. This Act of 1926 was replaced in the year of 1952 by another Act. This 1952 was replaced by the present Act 70 of 1971. The present Act is known as “The Contempt of Courts Act, 1971”. But the most unfortunate thing is that the …

From Energy Sector Inquiry To Recent Antitrust Decisions In European Energy Markets: Competition Law As A Means To Implement Energy Sector Regulation In Eu, Michael Diathesopoulos

Michael Diathesopoulos

This paper presents the conceptual path followed by European Union, European Commission and European Competition Network, after the Energy Sector Inquiry (2007) towards the realisation of the objective of an Energy Internal Market, fully functional and open to competition. Firstly, we examine the findings of Sector Inquiry and then we describe how the Third Energy Package - that followed - tried to address the issues highlighted by the Inquiry and how Third Energy Package introduces a promising but complex system, in order to develop sector rules. Following the above, we proceed to a brief but close examination of 10 recent …

Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos Jun 2010

Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos

Michael Diathesopoulos

This paper examines management contracts as a paradigm for the application of relational contracts theory and especially of the theory of contractual and relational norms. This theory, deriving from Macauley's implications, but structured and analysed by I.R. MacNeil gives us a framework for the explanation and understanding of contractual obligations and business relations' rules and practice. After presenting the key literature about the norms theory and especially defining the content of MacNeil's norms, we define management contracts as relations, characterised by a high relational element and we explain why, investigating all their features, which make them a suitable object for …

Reflexiones En Torno A La Compraventa De Bien Futuro, Jimmy J. Ronquillo Pascual

Jimmy J. Ronquillo Pascual

Failed Synallagmatic Contracts : Appraisal Of The Maxim "The Party Who Has Control And Can Insure Against The Loss Should Shoulder The Risk", Aimite Jorge

Aimite Jorge

The current position in South African law on enrichment situations arising from "failed agreements" is that "if you have received a performance in terms of a contract which subsequently fails for whatever reason, you give it back if you still have it; if you cannot give it back, you are absolved, unless you were culpable in relation to the loss". Daniel Visser, however, challenges this approach and proposes a new one in his recently published book, Unjustified Enrichment (2008). This article evaluates both this position and the newly suggested approach and it argues that in cases of failed synallagmatic contracts …

What Determines Professionals’ Bankruptcy Fees: An Empirical Investigation, Gijs Van Dijk, Martin Gramatikov Jan 2010

What Determines Professionals’ Bankruptcy Fees: An Empirical Investigation, Gijs Van Dijk, Martin Gramatikov

Martin Gramatikov

Countries have adopted different approaches to compensate bankruptcy trustees for winding up the estate. The approaches vary from state trustees to funding mechanisms where bankruptcy trustees receive a fixed fee, to a system where their fees depend on the size of the assets. Few studies have addressed the cost-effectiveness of the different approaches. This study contributes to this topic by examining the fees of the winding up, including an analysis of the determinants of these fees. After analyzing 289 Dutch bankruptcies consisting of short-term and medium-term cases, we find substantial differences in the mean hourly remuneration fees of bankruptcy trustees. …

Context Is Everything: Sociality And Privacy In Online Social Network Sites, Ronald Leenes Jan 2010

Context Is Everything: Sociality And Privacy In Online Social Network Sites, Ronald Leenes

Ronald Leenes

Social Network Sites (SNSs) pose many privacy issues. Apart from the fact that privacy in an online social network site may sound like an oxymo- ron, significant privacy issues are caused by the way social structures are currently handled in SNSs. Conceptually different social groups are generally conflated into the singular notion of ‘friend’. This chapter argues that attention should be paid to the social dynamics of SNSs and the way people handle social contexts. It shows that SNS technology can be designed to support audience segregation, which should mitigate at least some of the privacy issues in Social Network …

Bailment Or Lease: A Legal And Economic Analysis, Wei Zhang Jan 2010

Bailment Or Lease: A Legal And Economic Analysis, Wei Zhang

Wei Zhang

When customers temporarily deposit their personal properties with a business which collects a fee, either directly or by incorporating the charge into the price of its goods or services (such as a locker at the supermarket, a parking garage, or a bank safe deposit box), it has long been disputed whether a bailment or a lease contract arises between the two parties. In this paper, I tried to approach this problem from a law and economics perspective. Efficiency-oriented judges should establish rules motivating parties to take optimal precautions to minimize the social costs associated with the loss of the property. …

Contributory Negligence And Mitigation: Shall The Two Walk Together?, Dr. Yehuda Adar Jan 2010

Contributory Negligence And Mitigation: Shall The Two Walk Together?, Dr. Yehuda Adar

Yehuda Adar Dr.

-This Article is in Hebrew-

This paper discusses and critically examines the close interrelations of two of the main defences to liability in damages for torts and breach of contract. After a careful analysis of the various similarities between the doctrines of contributory (or comparative) negligence and mitigation of damages, and the basic difference between the two, the article reaches the conclusion that there is no justification for the ongoing existence of the mitigation doctrine. It should be abolished, and the doctrine of comparative negligence should be adopted across the board in both tort law and contract law.
