While it is a truism that people shape resources, it is equally true that resources shape people. This is so not only in terms of the individual but also of his society. Resources are the foundation of economic development - upon them turn such diverse questions as where a population will settle and the level of education required of that population for the harvesting of the resource. The regions of Canada are not diversified as much by strict cultural populations as with the resources which have shaped the regional populations. Recent case law developments in Ohio and West Virginia have narrowed the application of forfeiture in obtaining the termination of a coal mining lease for breach of express and implied covenants. This Note examines the law of forfeiture generally, and later discusses these recent cases and their ramifications.

The Rule Of Capture: Government And The Oil Industry, Joseph P. Tomain

The Oil Follies of 1970-1980 by Robert Sherrill, is a broad account of an important decade for energy law and politics. In a capsule review of the book, I noted that it is a journalistic, rather than an academic, look at the theory of capture as a way of talking about government regulation. Because Sherrill was writing for a predominantly lay audience, he did not undertake a systematic and rigorous analysis of the legal regulations concerning the petroleum industry. Nevertheless, his book does provoke a serious question: Is Big Oil bad, and if so, how should government regulate it? This …
