Colombia enacted the “family old-age pension” through Law 1580/12. This pension is not one of exceptional type, which is granted to certain beneficiaries: it is one that tries to expand the coverage of the pension system in a novel way. Thus, the right to a pension no longer will be a product of regular contributions or savings made on an individual basis, but one that will correspond to the sum of efforts made by the couple that makes up a family group. This paper addresses the current problem of interpretation of what should be understood as basic salary for the settlement of the pension bond type A mode 2, for members who move to individual savings scheme, showing how interpretations of the Constitutional Court and the Labor Appeal Chamber of the Supreme Court do not conform to the financial and economic content the law provides, and therefore, create problems of pension equity.

On The Judicial Interest Rate: A Comparative Law And Economics Perspective, Hugo A. Acciarri, Nuno Garoupa

Although all legal systems use some form of pre-judgment or post-judgment interest, there is no substantive law & economics literature providing for a comprehensive theory on the impact, functioning and assessment of the judicial interest rate. Mainstream legal scholarship has usually dealt with it as having neutral effects on private and social costs. In this paper we show that the issue is theoretically-wise far more complex and it has a definite influence on legal policy. Due to asymmetric opportunity costs for plaintiff and defendant, judicial interest rates may bring about improper delay of proceedings and/or decouple damages from recovery. Both …

Proteccion De Libertades Economicas En Peru: Un Analisis Estadistico Y Econometrico De Las Decisiones Del Tc, Óscar Súmar

Using econometric and statistical analysis, the paper has two major findings. The first is that, when the Constitutional Court uses the balancing test, the chances of the demand to be hold are bigger. The problem -if we consider desirable this kind of protection- is that the Court uses the balancing test in less than half of the cases and, when it does, it uses it improperly. The second finding is that, when the Court faces a demand about an economic right, the chances of the demand to be hold by the Court are lesser.

Redundancy of legal rules has bad press. Traditional legal literature usually regards any sort of redundancy as a flaw of legal systems. Scholars on Law and Economics accept, instead, some kinds of regulatory redundancy, but focus more on the redundancy of the sources of regulation (agencies) than on the pure effect of redundant rules whatever their source might be. Hence, the underlying issue remains: even on an efficiency basis, redundancy is primarily perceived as an undesirable feature of the legal system.
