A Review of the book Chinese Encounters by Inge Morath and Arthur Miller. Miller inquired about cultural and legal issues in China as one of the first American intellectuals to be given relatively free access to China since the Mao regime. Inge Morath provided remarkable photographs. The significance was the juxtaposition of Miller's adherence to the Western concept of the Rule of Law with the communitarian values of Chinese culture.

The fuzzy dichotomy between business or profit-motivated expenses and personal expenses has long plagued both taxpayers and the government, creating continuing confusion as to the deductibility for federal income tax purposes of expenses of maintaining a residence used for both personal and business or profit-oriented purposes. Internal Revenue Code (I.R.C.) 280A, which sets forth an exclusive series of circumstances in which such deductions are permissible, represents the latest phase in the ongoing battle and the first attempt to deal with the issues by statute. Enacted in 1976 and effective for taxable years beginning after 1975, 280 A seems to have …

This 1981 article contends, as its title suggests, that federal class actions should be brought only if class counsel believe they can represent the individual interests of the members of the class described in the complaint. After all, the mere filing of a class action complaint has legal consequences, and it is generally acknowledged that the members of even an alleged class have some right to rely on the class attorney to protect their interests. A certification order therefore does not create a class, but instead puts the court's imprimatur on class counsels’ representation that they can carry out rhw …
