The Liberal As An Enemy Of Queer Justice, Craig Schamel Oct 2015

The Liberal As An Enemy Of Queer Justice, Craig Schamel

Catalyst: A Social Justice Forum

Abstract

Liberalism as a historical mode of the political is the context in which the movement and ensuing struggle for queer justice emerged in most Western countries. The terminology, practices, tendencies, beliefs, ethics, laws, and patterns of political and social life which have been determined by this mode of the political, it is argued, are inimical to queer justice and render its achievement impossible. Liberalism as a mode of the political is approached from below, from knowledge gained in practical experience in queer groups which considered themselves revolutionary at least to some degree, and from the effects on such groups ...

Defective Designs In Airbag Technology, Benjamin Ashley Aug 2015

Defective Designs In Airbag Technology, Benjamin Ashley

The Forum: A Tennessee Student Legal Journal

Introduction: Airbags have been a major concern for automobile manufacturers and federal regulators. As of January 1, 2009, the National Highway Traffic Safety Administration (“NHTSA”) attributed “296 deaths to front airbags, including 191 children, 92 drivers, and 13 adult passengers . . . .”1 Airbag systems are designed to reduce injuries in motor vehicle crashes and especially in crashes at high speeds.2 However, airbags have deployed incorrectly or malfunctioned due to a defect in their designs,3 and their incorrect deployment or malfunction has caused serious injuries and even death for vehicle occupants.4

Although the technology to employ airbags was available ...

Understanding The Yoder Provision: Analyzing The Impact Of Amendments To Dodd-Frank's Swaps "Push-Out" Provision, William N Lay

The Forum: A Tennessee Student Legal Journal

Introduction: On December 16, 2014, Congress enacted the Consolidated and Further Continuing Appropriations Act, 2015 (Act) to fund the federal government through the 2015 fiscal year and forestall an imminent government shutdown.1 However, the content of this legislation was not limited exclusively to the allocation of funds; the Act controversially amended several provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank).2 In a section now known as the “Yoder provision,”3 the Act amended section 716 of Dodd-Frank, which originally required certain financial institutions to “push-out” certain swap transactions to outside institutions that were not ...

Amendment Ii: A Consideration Of The History, Passage & Potential Effects Of The Latest Judicial Selection Process In Tennessee, William H. Neal Iii, Jarrod B. Casteel

The Forum: A Tennessee Student Legal Journal

Introduction: On November 4, 2014, the Judicial Selection Amendment

(Amendment II) to the Tennessee Constitution came before the state’s

electorate. Amendment II sought to replace the role played by the Judicial

Nominating Commission by expanding the governor’s appellate judiciary

appointment power while simultaneously clarifying and codifying what is

known as the Tennessee Plan for judicial selection. Although some felt that

this amendment went directly against the measured determinations of the

state constitution’s drafters, Amendment II passed by a relatively wide

margin, thereby altering and solidifying the judicial selection process in the

State of Tennessee. While the voters ...

The Greenhouse Effect: Decomposition Rates In Human Remains Wrapped In Plastic, Barbara R. Forman Aug 2015

The Greenhouse Effect: Decomposition Rates In Human Remains Wrapped In Plastic, Barbara R. Forman

Masters Theses

Determining an accurate estimation of the postmortem interval (PMI) of human remains is important for several reasons. First, it is used to determine whether the individual is recently deceased, and therefore of medicolegal concern. If so, the estimated PMI is used in narrowing the possible identities of the deceased. PMI can also be used in excluding, or convicting, a murder suspect.

Though deviations may occur, it has been found that PMI can be calculated from the decomposition stages with reasonable accuracy (Galloway 1989, Megyesi 2001, Megyesi et al. 2005, Schiel 2008, Simmons et al. 2010). Some factors, such as low ...

Medicalizing Gender: How The Legal And Medical Professions Shaped Women’S Experiences As Lawyers, Kathleen Darcy May 2015

Medicalizing Gender: How The Legal And Medical Professions Shaped Women’S Experiences As Lawyers, Kathleen Darcy

Tennessee Journal of Race, Gender, & Social Justice

Despite significant progress, women in the legal profession still

have not advanced into positions of power at near the rate in which

they saturate the legal market. Scholars agree that simply waiting for

parity is not sufficient, and, thus, they have identified many of the

barriers that contribute to women’s difficulties. To date, however, the

role that scientific and medical understandings play on the evolution of

law, and on women as lawyers, has not received examination until

now. To this end, I posit that medicine played a significant role in

shaping societal expectations and assumptions about gender, and was ...
