Was The “S” For Silent?: The Maine Indian Land Claims And Senator Edmund S. Muskie, Joseph Hall Jan 2016

Was The “S” For Silent?: The Maine Indian Land Claims And Senator Edmund S. Muskie, Joseph Hall

Maine History

This article explores the work of one of Maine’s most powerful politicians, U.S. Senator Edmund Muskie, during one of Maine’s most difficult political crises, the Maine Indian Land Claims of the 1970s. In 1972, when Penobscots and Passamaquoddies challenged the legality of land sales conducted from 1794 to 1833, they called into question the legal title of the northern two-thirds of the State of Maine. Tom Tureen, the lawyer for the tribes, and Governor James Longley and State Attorney General Joseph Brennan, the state officials leading the case for Maine, played central roles in the case. Muskie played a crucial, …

Partisan Gridlock In The Contiguous States: Credit Ratings, Economic Stability, And The Ramifications Of Political Competitiveness, Polarization, And Party Control In U.S. State Legislatures, 1992-2010, Logan Nee Apr 2014

Partisan Gridlock In The Contiguous States: Credit Ratings, Economic Stability, And The Ramifications Of Political Competitiveness, Polarization, And Party Control In U.S. State Legislatures, 1992-2010, Logan Nee

Honors College

Today’s complex sociopolitical context features an increasing determent of fundamental bipartisan principles and negotiation at both the federal and state levels of government. A competitive political environment akin to post-Civil War times, amplified by growing partisan polarization and politicians’ quest for party allegiance and self-reward, pervasively discourages productive compromising efforts to work across the isle. We believe this hinders government’s sole and rather straightforward fiscal duty: to provide stable, healthy, and predictable economic conditions for its constituents. Credit ratings offer a window into the interaction of public policy, political uncertainty, and economic performance, which all lie at the nucleus of …

Safe To Drive? Police Powers Of Search And Seizure In The Vehicular Context, Mark Rucci

Honors College

Since their creation, automobiles have become a central facet of the American culture and psyche. As status symbols and modes of transportation their importance cannot be overstated. Americans love their cars, and the average citizen believes that he or she has legitimate privacy interests in his or her vehicle. But is this the case? For decades, The Court has struggled to balance 4th Amendment privacy rights with effective police procedure, and has thus handed down dozens of rulings on the topic, many of which often seem disparate and contradictory. In the face of such confusion, the Court’s answer has almost …

The Maine Indian Land Claim Settlement: A Personal Recollection, John M.R. Paterson Jun 2012

The Maine Indian Land Claim Settlement: A Personal Recollection, John M.R. Paterson

Maine History

From 1971 to 1980, the state of Maine grappled with one of the greatest legal challenges ever before it. That challenge had its origin in a suit brought by the Penobscot and Passamaquoddy tribes against the U.S. Department of the Interior seeking the seemingly simple declaration that the department owed a fiduciary duty to the tribes based on a federal law adopted in 1790. That suit was eventually to lead to a suit by the U.S. Department of Justice against the state of Maine, and potentially 350,000 residents in the eastern two-thirds of the state, seeking return of land taken …

At The Magistrate's Discretion: Sexual Crime And New England Law, 1636-1718, Abby Chandler Jan 2008

At The Magistrate's Discretion: Sexual Crime And New England Law, 1636-1718, Abby Chandler

Electronic Theses and Dissertations

This dissertation is a comparative study of sexual crime trials in four New England jurisdictions: Essex County, Massachusetts, Plymouth Colony, The Province of Maine, and Rhode Island Colony. It argued that sexual crime trials could be used as a tool for studying the diverse and changing legal cultures of different regions within New England. Whether morality or child support was under discussion, sexual intercourse outside of marriage threatened to disrupt the social and economic bounds of early modern society. Nevertheless, methods for addressing the issue varied widely in New England, depending on the jurisdiction in question. As a result, examining …
