And A Public Defender For All, Sara Mayeux
And A Public Defender For All, Sara Mayeux
Vanderbilt Law School Faculty Publications
The Senate confirmation of Ketanji Brown Jackson to the Supreme Court last week means that she is soon to be the first Supreme Court justice with prior experience as a federal public defender. This is historic in its own right, though it is not quite as surprising on closer inspection, since the institution of the federal public defender — in its currently prevailing organizational particulars, anyway — dates back only to the 1970s. Still, given that several of the justices previously worked as federal prosecutors, Jackson’s confirmation injects a welcome measure of professional balance to the lineup. Moreover, Jackson can …

The government system is looked to have an influential impact on a person’s life and the ability to trust the legal system is extremely important to have a working democracy. Changes need to be made in order to make the minorities feel like they belong. The history of segregation and descrimigation needs to end and the government needs to enact policies to make the minorities trust again in the system. College students have felt the pressure of social media in the wrongful treatment of minorities and seeing these things happen first hand. With the rise of technology these problems will …

Political Scientist Christina Rivers: Restoring The Fundamental Right To Vote, University Marketing And Communications, Christina Rivers
DePaul Download
A democracy that’s truly representative of the people depends on the people to exercise their right to vote. There are some groups of people, however, who regularly don’t vote—because they don’t know they’re eligible. Contrary to popular belief, in Illinois, a convicted felon regains eligibility to vote as soon as he or she leaves a corrections facility. Anyone awaiting trial in jail is eligible to vote, too. DePaul political scientist Christina Rivers, an expert in voting rights and a DePaul Presidential Fellow, helped pass legislation to provide voter education to soon-to-be released inmates. In this episode, she discusses these initiatives, …

How Media Impact Race Relations: Positive And Negative Historical Examples And Applied Psychological Principles, Sophia Nocera
Honors Theses
This thesis sought to examine how media influenced interracial relations in the 1920s and 1930s. It starts by defining necessary terms like media, race, racism, and stereotypes. Afterwards, studies which demonstrate that media reflect society are analyzed as well as studies which determine the extent of media influence on society. Media are the most influential on people who agree with the content provided and those who have no specific opinion on the issue at hand.
Next, psychological studies which determine the circumstances in which racist ideology is accepted the most are analyzed. This analysis determined that in-group versus out-group sentiments …

Human rights belong to individuals in virtue of their common humanity. Yet it is an important question whether human rights entail or comport with the possession of what I call group-specific rights (sometimes referred to as collective rights), or rights that individuals possess only because they belong to a particular group. The Universal Declaration of Human Rights (UDHR) says they do. Article 15 asserts the right to nationality, or citizenship. Unless one believes that the only citizenship compatible with a universal human rights regime is cosmopolitan citizenship in a world state – a conception of citizenship that is not countenanced …

Battering The Poor: How Georgia’S Mandatory Family Violence Classes Deny Indigent Defendants Equal Protection Of The Law, Whitney Scherck
Battering The Poor: How Georgia’S Mandatory Family Violence Classes Deny Indigent Defendants Equal Protection Of The Law, Whitney Scherck
Whitney Scherck
Thirty years ago, the U.S. Supreme Court in Bearden v. Georgia held that the Equal Protection Clause of the Fourteenth Amendment prevents a court from incarcerating an individual for failure to pay a fine unless it first inquires into their reasons for failing to do so and determines that the defendant willfully failed to make bona fide efforts to pay. However, recently, a new kind of legal debt has emerged. As states’ budgets tighten, so-called user fees are becoming an increasingly common way for legislatures to toughen the criminal justice system without having to come up with funding for it. …

Defining American: The Dream Act, Immigration Reform, And Citizenship, Elizabeth Keyes
Defining American: The Dream Act, Immigration Reform, And Citizenship, Elizabeth Keyes
Elizabeth Keyes
The DREAM Act and the grassroots movement propelling the legislation forward reveal how the definition of citizenship is undergoing a dramatic transformation, in ways both inspiring and troubling. The DREAM movement depends upon the compelling but exceptional stories of passionate, high-achieving, law-abiding youth who already define themselves as being American, and worthy of legal status. Situating this narrative in the rich literature of citizenship, the article shows how the DREAM movement effectively exposes the disjuncture between the DREAMers' identity as Americans and their lack of legal immigration status. The article celebrates how this narrative succeeds as a contrast to the …
