Salary History And The Equal Pay Act: An Argument For The Adoption Of “Reckless Discrimination” As A Theory Of Liability, Kate Vandenberg

The Equal Pay Act (EPA) purports to prohibit employers from paying female employees less than male employees with similar qualifications; however, the affirmative defenses provided in the EPA are loopholes that perpetuate the gender pay gap. In particular, the fourth affirmative defense allows for wage differentials based on a “factor other than sex.” Many federal circuits have read this defense broadly to include wage differentials based on salary history. That is, an employer can pay a female employee less than her male counterparts because she was paid less by her previous employer. While salary history was once viewed as an …

Research Brief: "Unemployment, Earnings, And Enrollment Among Post 9/11 Veterans", Institute For Veterans And Military Families At Syracuse University

This study found that Afghanistan/Iraq era veterans have a higher likelihood of unemployment than non-veterans, with female veterans faring worse than their male counterparts. In practice, female veterans of the post-9/11 era suffer from higher absolute levels of unemployment than male veterans, as well as also experiencing a higher unemployment penalty from their service relative to their civilian counterparts than male veterans do. In policy, policymakers may wish to determine ways to increase utilization of GI Bill benefits among disadvantaged populations to increase their long-term employment and earnings. [Excerpt] Why has Myth and Measurement engendered so much controversy? In part, because it deals with the minimum wage. The minimum wage was the first piece of protective labor legislation adopted at the national level, and proposals to increase the minimum wage invariably lead to heated debate between labor and business interests. When a book co-authored by the then chief economist in the Clinton Labor Department purports to show that, contrary to received wisdom, minimum wage increases do not appear to have any diverse effects on employment, it is predictable that conservative critics will attack its findings.

In this study, researchers found significant differences in employment among recently returned veterans based on age, health, and service era. The Iraq/Afghanistan-era veterans, ages 18-24, were more likely to have higher earnings if employed, while older veterans, ages 37-64, had higher odds of unemployment. In practice, veterans may be experiencing an employment divide in which those who can find work command high wages, while others are not able to find work at all. In policy, policymakers may wish to revisit these issues by increasing the availability of programs and services for older veterans and those from previous eras who are …

In 1965 Congress established the Social Security Student Benefit Program which provided benefits for children of deceased, disabled or retired workers, who were enrolled in college full—time and were not married, up until the semester they turned age 22. The program grew to be a major financial aid program; at its peak in FY 81 it represented about 20% of all federal outlays on student assistance for higher education. The program was terminated for students newly entering college as of May 1, 1982. [Excerpt] In Ricci v. DeStefano, the "New Haven Firefighters" case, whitefirefighters and one Hispanic firefighter sued the city of New Haven, Connecticut and city officials under Title VII. The plaintiffs claimed the city had committed intentional discrimination or disparate treatment against them when the city disregarded the results of promotion examinations that had an adverse effect on black and Hispanic applicants. The Supreme Court sustained the claim. In his concurring opinion, Justice Scalia invited attorneys in subsequent cases to consider arguing that the disparate impact theory of employment discrimination is unconstitutional. Excerpt] The New Jobs Tax Credit (NJTC) offers a tax credit of fifty percent of the first $4200 of wages per employee for increases in employment of more than two percent over the previous year. Economic theory predicts that such a tax credit should stimulate employment, decrease hours worked per week, and reduce product prices of the subsidized industries. A time series analysis of the construction, retailing, and wholesaling industries finds strong support for these hypotheses. Our results suggest that the NJTC was responsible for 150,000-670,000 of the more than 1-million increase in employment that occurred between mid-1977 and mid-1978 …
