Same-Sex Sexual Harassment: How The "Equal Opportunity Harasser" Became A Legitimate Defense, David Sherwyn, Ezekiel A. Kaufman, Adam A. Klausner Dec 2000

Same-Sex Sexual Harassment: How The "Equal Opportunity Harasser" Became A Legitimate Defense, David Sherwyn, Ezekiel A. Kaufman, Adam A. Klausner

Articles and Chapters

This article provides a quick history of sexual-harassment law and looks at the appellate-court opinions that came before the U.S. Supreme Court ruling in a same-sex sexual-harassment case. That latter decision has given rise to the relatively novel equal-opportunity-harasser defense, whereby harassing conduct directed at both men and women, no matter how outrageous, may not be unlawful at all. The reason is that the Supreme Court previously established that sexual harassment must be "because of sex," and failure to prove that gender-related component will automatically disqualify claims for quid pro quo or hostile-work-environment sexual harassment, as indicated by the ...

[Review Of The Book Environmental Regulations And Corporate Strategy: A Nafta Perspective], Lance A. Compa Dec 2000

[Review Of The Book Environmental Regulations And Corporate Strategy: A Nafta Perspective], Lance A. Compa

Articles and Chapters

[Excerpt] What can proponents of liberalized international trade do about barriers to trade erected in the name of environmental protection? What can corporate strategists do to expand their firms' trade opportunities in new institutional frameworks linking trade and environmental protection? The Canadian authors of Environmental Regulations and Corporate Strategy address these questions from backgrounds in management studies, economics, political science, international relations, and law. Drawing on each discipline, they set out an ambitious goal: "a new and unified model" for corporate strategy and public policy that reconciles trade promotion and environmental concerns.

Assessing The Proposed Iam, Uaw, And Usw Merger: Critical Issues And Potential Outcomes, Paul F. Clark, Lois Spier Gray Dec 2000

Assessing The Proposed Iam, Uaw, And Usw Merger: Critical Issues And Potential Outcomes, Paul F. Clark, Lois Spier Gray

Articles and Chapters

[Excerpt] We examine the many difficult issues facing the IAM, UAW, and USW as they move toward the creation of a single organization. In order to place this merger in con- text, the larger issue of mergers in the American labor movement will be addressed, as will the origins and history of each of the three unions. The specific issues confronting the unions will be examined in three categories — structure, administration, and functions and services. We conclude with an assessment of the current status of the unification effort and the prospects for its realization.

Emotion And Group Cohesion In Productive Exchange, Edward J. Lawler, Shane R. Thye, Jeongkoo Yoon Nov 2000

Emotion And Group Cohesion In Productive Exchange, Edward J. Lawler, Shane R. Thye, Jeongkoo Yoon

Articles and Chapters

This study refines and experimentally tests a theory of relational cohesion that explains how and when actors become committed to one another in the context of multiactor exchange. The theory asserts that frequent social exchange results in (1) positive emotions that solidify and strengthen the person-to-group bond and (2) uncertainty reduction that renders the focal group more salient in relation to others. These two mechanisms produce a sense of psychological group formation and ultimately increase observable acts of commitment. In a “productive exchange” setting, three actors negotiate a joint venture that requires the assent of all members. The exchanges featured ...

U.S. Workers’ Rights Are Being Abused, Lance A. Compa Oct 2000

U.S. Workers’ Rights Are Being Abused, Lance A. Compa

Articles and Chapters

[Excerpt] The 200-page Human Rights Watch report is based on case studies across a range of industries, occupations and regions of the United States. The report recognizes that U.S. workers generally do not confront gross human rights violations where death squads assassinate union activists or collective bargaining is outlawed. But the absence of systematic government repression does not mean that workers have effective exercise of the right to freedom of association. The case studies in the Human Rights Watch report uncover a distressing pattern of threats, harassment, spying, firings and other reprisals against worker activists and a labor law ...

The Economics Of Teams Among Technicians, Rosemary Batt Oct 2000

The Economics Of Teams Among Technicians, Rosemary Batt

Articles and Chapters

This paper examines the economic logic of organising field technicians into self-managed teams, an approach to work organisation that shifts the division of labour from a hierarchical to horizontal one. Economic efficiencies arise through the integration of direct and indirect labour tasks and the alignment of the organisational structure with the occupational logic of communities of practice among technicians. Self-managed teams absorb the monitoring and coordination tasks of supervisors, substantially reducing indirect labour costs but without adversely affecting objective measures of quality and labour productivity. For technicians, team membership means longer work hours, but higher wages through overtime pay.

Ngo-Labor Union Tensions On The Ground, Lance A. Compa Oct 2000

Ngo-Labor Union Tensions On The Ground, Lance A. Compa

Articles and Chapters

[Excerpt] There are serious tensions between NGOs and trade unions, two major advocates of workers’ rights, that underlie any discussion of workplace codes of conduct. The tensions stem from questions of legitimacy that bedevil both communities. Trade unionists see themselves as representing stable organizations with dues-paying members. They have a ready answer to the question “Whom do you represent?” The situation for NGOs is far more complex. No single organization speaks authoritatively for the NGO community. Unlike union leaders, NGO activists are not elected. Some NGOs are membership organizations funded by contributions from individuals. Payments are often sporadic and crisis-driven ...

Globalization, Workers, And Industrial Relations Institutions In Southeast Asia, Sarosh Kuruvilla Oct 2000

Globalization, Workers, And Industrial Relations Institutions In Southeast Asia, Sarosh Kuruvilla

Articles and Chapters

[Excerpt] Much of my research focuses on industrial relations (the relationship between managers and labor - mostly represented by trade unions). Thus, typically l study the impact of changes in the environment (be it economic, social, political, or legal environments) on the goals and strategies of employers and workers. In writing this article, I am using a particular case to provide readers with a flavor of the research that I conduct.

Currently, there is much interest in how globalization (change in the economic environments) is affecting Southeast Asia. On this note, I'd like to briefly examine how the Asian financial ...

Death And Disability In The Heartland: Corporate (Mis)Conduct, Regulatory Responses, And The Plight Of Latino Workers In The Meatpacking Industry, Anna-Maria Wahl, Steven E. Gunkel, Thomas W. Sanchez Oct 2000

Death And Disability In The Heartland: Corporate (Mis)Conduct, Regulatory Responses, And The Plight Of Latino Workers In The Meatpacking Industry, Anna-Maria Wahl, Steven E. Gunkel, Thomas W. Sanchez

Sociology and Anthropology Faculty Publications

Death and disability remain serious problems in the meatpacking industry, which increasingly depends on Latino workers. Here we examine these problems and the dynamics that heighten and minimize the hazards encountered in meatpacking plants. Drawing from published and unpublished sources, we provide statistical profiles and ethnographic accounts to capture the health and safety risks Latino workers face in the meatpacking plants of Iowa, Kansas, and Nebraska. Guided by recent research in labor market segmentation and the politics of social regulation, we trace the increased risk of injury and illness for Latinos to three intersecting dynamics: corporate conduct and misconduct on ...

[Review Of The Book Labour History And The Labour Movement In Britain], George R. Boyer Oct 2000

[Review Of The Book Labour History And The Labour Movement In Britain], George R. Boyer

Articles and Chapters

[Excerpt] While this volume contains some important pieces, it is uneven in quality, and several of the papers, in my opinion, should have been omitted. Given the very high price of the book, the fact that it omits Pollard's important papers on factory discipline and his chapter from the Cambridge Economic History of Europe, and the ready availability in journals of the best papers, I cannot recommend it to anyone but librarians who happen to have unlimited sources of money. One can only hope that in the future Ashgate or another publisher will reprint, at reasonable prices, Sidney Pollard ...

Unions And The Labor Market For Managers, John Dinardo, Kevin F. Hallock, Jörn-Steffen Pischke Aug 2000

Unions And The Labor Market For Managers, John Dinardo, Kevin F. Hallock, Jörn-Steffen Pischke

Working Papers

We examine the relationship between the employment and compensation of managers and CEOs and the presence of a unionized workforce. We develop a simple efficiency wage model, with a tradeoff between higher wages for workers and more monitoring, which requires more managers. The model also assumes rent sharing between workers, managers and the owners of the firm. Unions, by redistributing rents towards the workers, lead to lower employment and lower pay for managers. Using a variety of data sets, we examine the implications of the model for the relationship between the employment and wages of managers and unionization. We find ...

Works In Progress: Constructing The Social Dimension Of Trade In The Americas, Lance A. Compa Jun 2000

Works In Progress: Constructing The Social Dimension Of Trade In The Americas, Lance A. Compa

Articles and Chapters

[Excerpt] This paper reviews labor rights in the trade arrangements of four regional and binational settings in the Americas:

• the North American Free Trade Agreement (NAFTA) among Canada, Mexico and the United States;

• the Common Market of the South (Mercosur) among Argentina, Brazil, Paraguay and Uruguay;

• the Canada-Chile Free Trade Agreement (CCFTA); and

• the Caribbean Community (Caricom) embracing several island nations in a common market.

The labor rights agreements, charters and declarations examined here are at different levels of development and experience. They are "works in progress," just beginning to experiment with the central challenge of ensuring that no country ...

Representing Difficult People, Ken Margolies May 2000

Representing Difficult People, Ken Margolies

Articles and Chapters

[Excerpt] Few stewards would argue that most of their union work flows directly from problems with management. Contract misinterpretations and outright violations, thoughtless supervision, paperwork foulups and a million other things go wrong all the time, adding up to a real handful for stewards. That’s why it can be such a frustration when some of your most difficult problems come not from management, but from your own ranks.
