The Institutional Entrepreneur As Modern Prince: The Strategic Face Of Power In Contested Fields, David Levy, Maureen A. Scully Dec 2011

The Institutional Entrepreneur As Modern Prince: The Strategic Face Of Power In Contested Fields, David Levy, Maureen A. Scully

David L. Levy

This paper develops a theoretical framework that situates institutional entrepreneurship by drawing from Gramsci’s concept of hegemony to understand the contingent stabilization of organizational fields, and by employing his discussion of the Modern Prince as the collective agent who organizes and strategizes counter-hegemonic challenges. Our framework makes three contributions. First, we characterize the interlaced material, discursive, and organizational dimensions of field structure. Second, we argue that strategy must be examined more rigorously as the mode of action by which institutional entrepreneurs engage with field structures. Third, we argue that institutional entrepreneurship, in challenging the position of incumbent actors and ...

Martha Stewart Saved! Insider Violations Of Rule 10b-5 For Misrepresented Or Undisclosed Personal Facts, Joan Heminway Oct 2011

Martha Stewart Saved! Insider Violations Of Rule 10b-5 For Misrepresented Or Undisclosed Personal Facts, Joan Heminway

Joan M Heminway

This article analyses the criminal securities fraud charges brought against Martha Stewart. Stewart was acquitted of these charges by a federal district court judge in February 2004. Specifically, the article initially focuses on whether the securities fraud charges brought against Stewart were valid as a matter of prosecutorial discretion and substantive law and whether the court was correct in granting Stewart's motion for acquittal before handing the rest of her case to the jury for deliberation. The article then offers substantive and procedural observations about Rule 10b-5 cases like the one brought against Stewart.

Ownership Unbundling In European Energy Market & Legal Problems Under Eu Law, Michael Diathesopoulos Sep 2011

Ownership Unbundling In European Energy Market & Legal Problems Under Eu Law, Michael Diathesopoulos

Michael Diathesopoulos

In this paper we will examine the issue of ownership unbundling and forced divestiture remedies imposed in a series of recent competition law cases of the energy market - examined in other papers - in relation to the possible existence of a series of legal obstacles. These energy market decisions belong to a group of antitrust cases in which a structural divestiture remedy has been imposed under the provisions of Article 9 of Regulation 1/2003. This divestiture refers to transmission networks and to generation capacity and is meant to lead to severe structural changes, which are compatible with the findings of ...

Coöperaties In Zorg. Een Verkenning Van Vraagstukken En Goede Praktijken In Binnen- En Buitenland, Wim Van Opstal May 2011

Coöperaties In Zorg. Een Verkenning Van Vraagstukken En Goede Praktijken In Binnen- En Buitenland, Wim Van Opstal

Wim Van Opstal

Competition Law And Sector Regulation In The European Energy Market After The Third Energy Package: Hierarchy And Efficiency, Michael Diathesopoulos Apr 2011

Competition Law And Sector Regulation In The European Energy Market After The Third Energy Package: Hierarchy And Efficiency, Michael Diathesopoulos

Michael Diathesopoulos

The aim of this research is to provide the basic parameters for a model for the definition of the relation between the general competition and sector specific frameworks and rules regarding the regulation of the Internal Energy Market, especially after the Third Energy Package. The research considers the recent sector specific framework in relation to a series of recent competition law cases of the Energy Market where structural remedies were applied under the commitments procedure. Essential facilities doctrine and generally competition law tools do not seem to provide a suitable framework for effectively addressing the dynamic competition concept, treating the ...

Job Satisfaction In The Public Service: The Effects Of Public Service Motivation, Workplace Attributes And Work Relations, Jeannette Taylor, Jonathan H. Westover Apr 2011

Job Satisfaction In The Public Service: The Effects Of Public Service Motivation, Workplace Attributes And Work Relations, Jeannette Taylor, Jonathan H. Westover

Jonathan H. Westover

What satisfies a public servant? Is it the money? Or is it something else, like an interesting and autonomous job, or serving the public interest? Utilizing non-panel longitudinal data from the International Social Survey Program on Work Orientations across different countries for 1997 and 2005, this article examines the effects of a selection of antecedents that are commonly related to job satisfaction. The respondents from different countries were found to share similarities in terms of what satisfies them in their jobs. The emphasis placed on these factors was however found to vary for some countries.

Il Comitato Per Il Controllo Interno E Per La Revisione Contabile Introdotto Dall’Art. 19 Del D.Lgs. 39/2010: Riflessioni In Sede Di Prima Istituzione Alla Luce Delle Indicazioni Dell’Unione Europea, Claudio Sottoriva Mar 2011

Il Comitato Per Il Controllo Interno E Per La Revisione Contabile Introdotto Dall’Art. 19 Del D.Lgs. 39/2010: Riflessioni In Sede Di Prima Istituzione Alla Luce Delle Indicazioni Dell’Unione Europea, Claudio Sottoriva

Claudio Sottoriva

Executive Compensation: The Role Of Shari’A Compliance, William Marty Martin, Karen Hunt Ahmed Feb 2011

Executive Compensation: The Role Of Shari’A Compliance, William Marty Martin, Karen Hunt Ahmed

Karen Hunt Ahmed

Abstract Purpose The purpose of this paper is to illuminate issues surrounding executive compensation as it relates to current understandings of Islamic business law. Methodology We review the emerging bodies of literature in the fields of executive compensation and opinions of stock options under Shari’a law. Findings It appears that the trend in offering employee stock options as part of a Shari’a compliant compensation package is acceptable in most cases, yet because of its close association with the more problematic idea of derivative transactions, the company must be vigilant in obtaining the approval from its Shari’a Standards ...

The Antecedents Of Value Creation In Singapore Corporation, Wee Liang Tan, Teck Meng Tan Jan 2011

The Antecedents Of Value Creation In Singapore Corporation, Wee Liang Tan, Teck Meng Tan

Wee Liang TAN

The impetus for value creation has led to greater interest in encouraging entrepreneurship within organizations (intrapreneurship). The intrapreneurship literature reveals general agreement that organizational entrepreneurship flourishes where the environmental conditions of an organization are most favorable. However, there is little empirical research examining the relationship of the organizational climate and the intentions of employees to be intrapreneurs, and their actual participation in such activities. This paper reports a study on the elements of organizational climate on intrapreneurship attitudes, intentions and actions on the part of middle managers in corporations in Singapore.

Collective Choice, Justin Schwartz Jan 2011

Collective Choice, Justin Schwartz

Justin Schwartz

This short nontechnical article reviews the Arrow Impossibility Theorem and its implications for rational democratic decisionmaking. In the 1950s, economist Kenneth J. Arrow proved that no method for producing a unique social choice involving at least three choices and three actors could satisfy four seemingly obvious constraints that are practically constitutive of democratic decisionmaking. Any such method must violate such a constraint and risks leading to disturbingly irrational results such and Condorcet cycling. I explain the theorem in plain, nonmathematical language, and discuss the history, range, and prospects of avoiding what seems like a fundamental theoretical challenge to the possibility ...

Finding A Jewel: Identity And Gendered Space In Islamic Finance, Karen Ahmed Dec 2010

Finding A Jewel: Identity And Gendered Space In Islamic Finance, Karen Ahmed

Karen Hunt Ahmed

In this article, I explore how globalization discourses practices work together to form the identities of female Islamic bankers working in the first stand-alone women’s Islamic bank in Dubai, United Arab Emirates. An Islamic bank interacts with the individual by providing a discursive and physical space in which the subject can shape and respond to her desire to identify and engage with the debates in the global Muslim community about morality, practice and the role of Islam in every day life. Global financial systems and local gender practices are embodied in these buildings in a kind of financial purdah ...
