An Ethical Analysis Of The Second Amendment: The Right To Pack Heat At Work, William Martin, Helen Lavan, Yvette Lopez, Charles Naquin, Marsha Katz

We examine the issues concerning the legality and ethicalityof the Second Amendment right to bear arms balanced by the employer’s duty to provide a safe workplace for its employees. Two court rulings highlight this balancing act: McDonald et al. v. City of Chicago et al. and District of Columbia v. Heller. “Stand Your Ground” and “Castle Doctrine” laws in the recent Traven Martin shooting on February 26, 2012 are also applicable. Various ethical frameworks examine the firearms debate by viewing the Second Amendment from three perspectives. Whistleblowing In Organizations: A Logit Analysis Of Litigated Cases, Yvette P. Lopez, Helen Lavan, Marsha Katz

This study examines the issue of whistleblowing in organizations. As suggested by the literature, a variety of legal protections and issues were examined to predict case outcomes in future litigation by individuals who engage in the act of whistleblowing. We used chi square analyses and a logit model to predict when an individual plaintiff would prevail, and the results indicate that case characteristics including discrimination laws, safety behavior, sexual harassment, and refusal to participate in illegal activities are significant predictors. The odds of a finding in favor of the employee increase with the presence of these particular case characteristics. Our …

Labor management relations in the hospitality sector is an important aspect of effective management. Increasingly, unions are becoming proactive in organizing hospitality workers. This manifests itself in strikes, boycotts, picketing, sexual harassment complaints, and complaints to OSHA regarding safety and health workplace violations. This research monitors the current scene with respect to labor management relations and analyzes work issues that have been brought up for third-party resolution by NLRB staff or arbitrators. The study reports on 66 NLRB cases and 104 arbitration cases. Issues brought before the NLRB include mostly contract interpretations. In arbitration, there were mostly discipline issues, including …

Logit Model To Predict Outcomes Of Litigated Employee Obesity Cases, Helen Lavan

Obese employees have questionable legal status, in that there are no real direct legal protections under existing law. A random sample of 80 litigated obesity cases was analyzed in the present study. The frequencies, chi square analysis, and logistics regression model suggest case characteristics in which the employer prevails. Future directions are discussed, including the changing definition of disability under Americans With Disabilities Act, exceptions in court rulings, changing the issue of voluntarism and mutability as irrelevant under the Equal Employment Opportunity Commission guidelines and the recognition of metabolic syndrome as a disability.

Competition and entrepreneurship are driving forces in the development of economic systems. They create jobs, new opportunities to generate value, and lead to the fulfillment of personal career and life goals. As such, it is important to understand the basic economic and cultural factors that influence these activities in developing economies. We undertook a series of analyses in an examination of a heterogeneous sample of economic zones in Southeast Asia.
