Both antitrust and IP law are limited and imperfect instruments for regulating innovation. The problems include high information costs and lack of sufficient knowledge, special interest capture, and the jury trial system, to name a few. More fundamentally, antitrust law and intellectual property law have looked at markets in very different ways. Further, over the last three decades antitrust law has undergone a reformation process that has made it extremely self conscious about its goals. While the need for such reform is at least as apparent in patent and copyright law, very little true reform has actually occurred.

In the ongoing discussions about financial services regulation, one critically important topic has not been recognized, let alone addressed. That topic is what this Article calls the “entity-centrism” of financial services regulation. Laws and rules are entity-centric when they assume that a financial services firm is a stand-alone entity, operating separately from and independently of any other entity. They are entitycentric, therefore, when the specific requirements and obligations they comprise are addressed only to an abstract and solitary “firm,” with little or no contemplation of affiliates, parent companies, subsidiaries, or multi-entity enterprises. The quarter’s Mountain Monitor marks the four-year anniversary of Brookings Mountain West's quarterly tracking of the uneven pace of recovery across the major metro areas of the Intermountain West and it finds that, although the region continues to outperform the national economy the rate of recovery slowed moderately in the region’s metro areas.

As a group, Mountain region metro areas advanced on all four indicators of economic recovery tracked by the Monitor—employment, output, unemployment, and house prices—but their progress was more restrained in the third quarter of 2013 than it was in the second.

This article critically compares China's rare earth policy with perspectives upheld in the rest of the world (ROW). We introduce rare earth elements and their importance for energy and present how China and the ROW are framing the policy debate. We find strongly dissonant views with regards to motives for foreign direct investment, China's two-tiered pricing structure and its questionable innovation potential. Using the metaphor of "China Inc.", we compare the Chinese government to a socially responsible corporation that aims to balance the needs of its internal stakeholders with the demands from a resource-dependent world. Patent Value And Citations: Creative Destruction Or Strategic Disruption?, David S. Abrams, Ufuk Akcigit, Jillian Popadak

Prior work suggests that more valuable patents are cited more and this view has become standard in the empirical innovation literature. Using an NPE-derived dataset with patent-specific revenues we find that the relationship of citations to value in fact forms an inverted-U, with fewer citations at the high end of value than in the middle. Since the value of patents is concentrated in those at the high end, this is a challenge to both the empirical literature and the intuition behind it. The purpose of this study was to assess the economic impacts and visitor use of the Beartooth Highway. Data was collected from visitors during the 2012 summer and 2012-2013 winter seasons. In total, over 4,000 summer visitors and 1,600 winter visitors were intercepted during the study. This report is a compilation of three separate studies conducted along the Beartooth Highway with a summary and researcher observations in the introductory pages.

The purpose of this study was to assess quality of life and image perceptions of Gardiner by residents, as well as their support/attachment to their community. A door-to-door survey was administered in June, 2013. The survey was completed by 209 Gardiner residents for a 60% response rate. The positive image held by Gardiner residents is a community that is friendly, supportive, and has a unique and rich heritage. On the negative side, the community is one with roads that are not well maintained, has little parking available, and has a lack of retail shopping opportunities. Residents were asked to identify …

As he promised during his election campaign, President Carter has proposed a major overhaul of the welfare system. Under the Better Jobs and Income Act, unveiled in August 1977, the major components of the current welfare system would be replaced by a program combining cash assistance and job opportunities. This paper evaluates the Carter proposal based on the experience under existing employment, training and welfare programs and then assesses its potential impact on the states of New Hampshire and Massachusetts. The Mountain Association of Community Economic Development (MACED) serves a fifty-four county region in Central Appalachia and is legally registered as a Community Development Financial Institution (CDFI). MACED provides financial capital and technical assistance to small businesses and nonprofit organizations in order to generate new employment opportunities and develop a strong local economy and community in its service region. My study explored how MACED can improve its evaluation system for assessing clients' technical assistance needs and how it can better understand the impact of these services.

This paper focuses on the American states and the sources of the expanding structural imbalance between their highway-related revenues on the one hand and expenditures for transportation infrastructure needs on the other. The paper describes the roots of the funding problem over recent decades, looks at some of the responses taken at the state and federal level, and discusses their inherent limitations as solutions to this funding crisis. The paper also presents several policy recommendations for increasing revenues. Each year, around half a million Indonesians travel abroad to work, half of those to the Middle East. They are typically women from small cities or villages with primary education and limited work experience, hired to perform domestic work. Many suffer abuse and exploitation but have virtually no access to recourse within their host country’s legal system.

The vulnerability of migrant workers abroad makes it crucial for them to be able to seek redress in their own countries. Access to justice at home also allows for redress when home governments and private recruitment businesses breach their legal responsibilities to migrant …

Here’s a well-kept secret: The regional GRTC Transit System is among the most progressive organizations in Richmond. The nonprofit plays a major role in reducing pollution, easing traffic congestion and connecting people to jobs. Its reform-minded leadership is eager to play a larger role. Its unionized bus drivers, which included some of the first waves of black and female drivers, help hold it all together.

And those drivers love their jobs — to a degree unusual for workers in any profession. That’s what I learned through interviews with 16 current and former drivers this summer for an exhibition at the …
